Bank charges barclay card - is it too late to claim now

Hello

 

 

now that I found some confidence

I thought I may try my luck with Barclay card charges that I had B/card.

 

 

Only problem is the card now closed.

 

 

Paid outstanding balance in 2014.

 

 

How far can I claim - from 2010-2014?

 

Appreciate any advice. Many thanks

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

You can claim as far back as you have, or can get, info for default charges. If you have all your old data, you can list the charges on a spreadsheet as per the examples on other *WON* threads.

 

If you don't have all the data for the periods when you think you were hit with default charges, send BC a SAR asap.

Many thanks DX and Slick132 - I am going to send the SAR and see what they have and will start sending the letters accordingly. The Default mark was there until last December when it was SBd and disappeared from the CRA file. Would that be a problem as the there is no debt at the moment. Your posts are very encouraging. I wish I had seen this few years ago when I was in deep trouble. But hoping for a good result (being optimistic).

Hi CB,

 

1. Do you not have any old statements or data about default charges. If you do, what dates do you have data for.

 

2. Roughly when did you open the BC a/c.

 

3. I assume you defaulted on the a/c around 2010 - is that right.

 

4. On your CRA file, who is the latest owner of the debt.

 

Once you have data about the default charges, you can let us know how the charges plus compound int't (at 24.9% or 29.9%) compare with the balance owed on the a/c.

 

The fact that this is being dealt with later rather than sooner may work in your favour due to the significant effect of claiming compound interest. Depending on the dates when you suffered default charges, you may be very surprised at the amount you try to reclaim.

Hi Slick - Many thanks for your response. When I moved my last house I was annoyed with myself about all my debts and I burnt all the statements as I did not want look at them again. I regret now because I could have claimed ages ago. I did not know about this Forum at the time and did not have anyone to help me. I am so grateful that this actually exists so people can get help in dire situations.

3. I assume you defaulted on the a/c around 2010 - is that right. - Yes I think so. I looked at the CRA file in 2013 and it says an Arrangement started in 2011 and ended in 2013. It does not say defaulted.

Yes - sorry I meant SAR. Letters sent to Llloyds re charges with schedule of charges. Letter sent to Barclaycard for SAR. I sent to 1, Churchill Place address - is this the correct address for Barclaycard?

 

I saw it somewhere this address.

So now waiting to hear from them.

Going to start the SAR letter to Creation Finance as well.

Get a free Cert of Posting at the PO when you send it, or use RM Signed For delivery if you're willing to pay the extra.

 

Get the SAR off asap to avoid possible loss of older data.

Thanks Slick. Sent to Barclaycard to the address that you have given above.

So I think I will have to wait 40 days to receive the documents. Then go from there doing the spreadsheet once I have all the statements etc.

I called Barclays to check the progress on SAR request as I have not heard, and they wanted to know why I wanted these. I told them I need to check the statements.

 

Do they normally ask you why wanted to do a SAR requests.

They may have wanted to know if you were reclaiming PPI, in which case they may have offered you an alternative route that did not involve the SAR and £10 fee.

 

Stay OFF the phone generally and keep all comms in writing only.

 

If they fail to send the SAR data back within the 40 days, there's a chasing letter letter in the library.

Thanks Slick. If they don't comply within the time limits I will send the other letter.

 

It was not relating to PPI, but it was the DN put on my CRA file that I wanted to check to see if there was another card and or if there was another agreement.

 

 

I think they do move the cards around because I seemed to have two different card nos both are now paid off in 2010.

 

I just need to double check before I send them a strong letter regarding the DN note.

I know it wasn't about PPI. I was suggesting why BC might ask you why you wanted the SAR.

 

In any event, when the SAR deadline is up, send the chaser letter and stay OFF the phone.
