Hi All,

Massively need some advise,

 

i had parked in a car park for 28 days thinking that it was a gem and free

but have now been hit by civil enforcements and their ANPR, 28 x £60 tickets.

 

desperately need some advice,

 

their notice to keeper was received 1 month after the violation so is this enough to get it squashed?

 

It was outside a Co-op and i just thought it was for customers and didnt carry a fine

and especially after not seeing a ticket on the window carried on.

 

if i had received the NTK within the 14 days i would have obviously moved!

 

Any help would be appreciated here as 28x £60 will break me!

the space is behind a train station and opposite a coop,

it has a paid for parking area to the right and around 10 spaces infront reserved for coop customers (which i am),

 

 

i work literally a stones throw away so just parked there thinking it was free

however on closer inspection its only free for 2.5 hours.

 

i had no idea ANPR operated so when i didnt get a ticket just thought id hit gold.

 

received 3 tickets now (1 a day) and by my maths ive parked there for 28 days in total.

Normal PCN £60 now or £100 after 14 days.

 

The main thing i can see so far is that (well at least the first 3) there all over the 14 days period required to notify the keeper?

 

i have in my panic last night sent an appeal see below -

 

Dear Sir

 

Ref PCN xxxxxx

 

This is not an appeal

 

I have received your letter dated xxxxxxx that purports to be a Notice to Keeper

 

You were fully aware when you sent it that you had failed to meet the clearly stated conditions of the Protection of Freedoms Act with it being sent 30 days after the stated act

 

I have no obligation to identify the driver and you have no right to pursue me as keeper

As I have no liability, I will not waste my time appealing the notice

 

I have, however, acted reasonably by engaging with your company

 

Don't contact me again.

My position is final and I will not reply

 

have i done the right thing?

well you've certainly nailed your colours to your flag pole.

 

I suspect they don't even own the land

nor have planning permission from the council for them.

 

so can do bugger all anyway.

 

find out who owns the land

and get pictures of all the signs

these will help people here to further advise.

your response is fine, they may or may not take any notice.

CEL no longer have a contract with the co-op but that doesnt seem to have put them off trying to persuade you to part with a bundle of cash.

 

 

You are right, they have to have the NTK on your doorstep within 14 days of the event in question so it seems like yours will be timed out for keeper liability. Never say who was driving as that is a different matter.

 

My only concern is the fact that they may be too tempted by the thought of thousands of pounds in missed revenue so you may well hear more from them.

 

 

Ashley is not averse to ignoring the law of the land and harassment is hard to define

so let us know if you get any more demands and we will try and advise what to say next, if anything different needed.

 

A complaint to the Co-op head office may well be part of a response if it does continue.
