I had a Barclaycard roundabout 2005

- I have only one statement as proof which shows a balance of £2,156.

Account closed due to non payments and sent to 1st Credit debt collection agency in Oct 2006 with a balance of £2,541.90 outstanding.

The debt was never settled as I had to leave my job to become a full time carer for husband with motor neurone disease.

got a letter recently regarding 'Payment Break Plan' attached to this Barclaycard which showed first 4 digits of the account number, my name, address etc

I am totally unsure of how to answer the questions to be successful in getting a refund.

I can't remember any details at all BUT what is more annoying is that some time ago,

I applied for a refund of PPI charges on this Barclaycard

and they told me that they no longer have my account information so cannot investigate any PPI claim.

If this is the case, how can they now be asking me about the PBP?

Are they lying about the PPI claim?

Should I reply with this PBP questionaire

(but please can someone help as I cannot remember details

- are they trying to catch me out by wanting me to slip up?)

If they are asking me about PBP, do they know the details of my account?

And should I then challenge them about the PPI claim?

I started loads of claims for PPI back in 2006-7 but when our world fell apart with the diagnosis of MND

everything just went by the wayside and they were all left half done.

.is it worth pursuing them all again?

Should I start completely afresh?

What are my chances after all this time?

It's PPI for 3 store cards (now owned by New Day),

bank charges with Lloyds and Santander,

PPI with Lloyds and Barclays....

....help please!

Thanks :|

yes ofcourse you can start it all again.

pers i'd NOT use their customer questionnaire {CQ]

but use the FOS one.

however.

it might pay you to send an SAR to BC

get all the statements

then you can CHECK they aren't fleecing you

the same process goes for the other cards.

if you type in monument payment break plan

in the search cag box of the red top toolbar

there are many threads there to help you.

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi CS and welcome to CAG

Was anything paid towards this a/c since 2006 - if not, the debt is now Statute Barred.

Who is the PPI or PBP letter from.

It's PPI for 3 store cards (now owned by New Day),

bank charges with Lloyds and Santander,

PPI with Lloyds and Barclays....

Historic bank charges will not be repaid to you.

Reclaiming PPI for store cards and bank loans is still an option but may depend on what debt still exists and who owns it.

I paid small amounts once it went to 1st Credit

and eventually gave up on trying to sort out the debts as there were too many to deal with

on top of my husband's terminal diagnosis...

What does Statute Barred mean?

I am currently £2000 + behind with the mortgage so is this not classed as hardship?

I have read some threads about hardship cases being successful.

This particular case is the Payment Break Plan and the letter regarding it from Barclaycard...thanks

Hover over the Auto-Link where the words Statute Barred are in capitals and an info box opens to explain the simple principles of a debt being Statute Barred.

When did you last pay anything toward the BC a/c.

The test for whether you're in Financial Difficulty is a Budget Planner which takes account of all your income and expenses. If you're in FD's, you could ask the bank and credit card co. to stop adding interest and/or penalty chgs AND to refund penalty chgs added recently to your a/c's.

Otherwise, a claim for FD's is not likely to result in the refund of historical penalty charges.
