  1. true. However, i plan on overpaying and getting it sorted early. second hand cars are overpriced currently and it would end up costing me a chunk to get something else.
  2. just a quick update DX I am now about 50% way through my Car HP. you mentioned it at the beginning of my thread. what were your suggestions here?
  3. thanks for confirming. It screamed bluff to me
  4. Hi all, quick update. after PRA Group not providing suitable details in response to my CCA request they have now sent through 1 years worth of card statements from july 2020 to july 2021. All details seem correct but their header letter to me says they have enclosed copy documents as requested. To contact them within 14 days to speak to them to discuss a mutually acceptable agreement to settle the outstanding balance. I find this a little strange as the CCA agreement requests the original agreement, statements would be part of starting the PAP route for legal. no letter of claim no mention this is now "enforceable" could this just be the equivalent of attempting to look like they have me by the balls? without mentioning this being enforceable or sending me the original CCA details should I just look at this as a bluff? I can scan up but are double sided and quite some paperwork. they have card number, original address and all looks correct.
  5. Looked up the agreement and the dates are correct so I guess they have me on that one. What information is required within the agreement to make this enforceable? I would have thought something with my given credit limit would be required. Il rescan the MBNA agreement, even from the original the text is way too small to read well! I would imagine a CCJ will come for sure on the first. should I ignore until they force my hand or shall I offer a token payment?
  6. let me know if the quality is ok? the original came to over 110MB
  7. CCA - LinkF - MBNA_compressed.pdf I will sort the PRA one but this is unenforceable currently. I have been reading up on the Bills of exchange act 1882 - is this something with some legal force if i end up infront of a judge in future? link CCA return HBOS credit card 2014.pdf
  8. Will do. Where should I send it? Just on the thread? The actual agreement part is seriously tiny print I can barely read it so I hope it shows up on the scan.
  9. new update. PRA Group have responded with a partial recon version and deemed unenforceable until they get the remaining (wasted time on their part in my opinion) Also Link Financial have sent me one response with what looks like an original agreement with the online tick box and date with my old address and is enforceable. What seemed which strange on this was in one part of the agreement details the word "Stolen" from cards lost or stolen has been redacted on the page - very weird. What would you suggest? I am happy to ignore them but would a token payment be worth my time? I seriously dont want to have to be paying these parasites a penny.
  10. but if they do provide the agreement, it has to have my signature and dated surely?
  11. just a quick update. so far 3 accounts have been sold on one Halifax to Link MBNA to Link BC to PRA Group Have sent all CCA requests. PRA sent back my PO saying they dont charge along with something saying they dont have to send me details of their purchase and that they dont have to provide a copy of the original agreement with my signature but acknowledged it unenforceable. Link have so far exceeded the timeframe to respond with only one letter so far for the Halifax request stating the OC confirmed they couldnt respond within the time frame. no return of my PO. I would assume without a copy of my original signed for copy of the agreement they shouldnt be able to enforce as they are missing my acceptance of the original agreement? I would also expect Link to reemburse my PO as they have failed to comply with the request within the time allowed.
  12. I was sent a letter by BC saying that i wasnt making my contractual payments and that they were giving me until early June to contact them and start paying my minimum again or they will issue a default on my account. They sent me a letter about 2 weeks before their self imposed deadline to contact them stating they were issuing the default regardless. Just thought it was a bit premature to say one thing and then not honour their own terms.
  13. quick update PRA Group today sent me a letter saying they wish to speak with me to talk about a potential discount Havent sent them CCA request yet. also, after going through my paperwork B/C sent me a letter stating they would default me by June 3rd if i didnt call them to discuss paying minimum again and then defaulted me nearly 2 weeks prior to this deadline. Does that have any significance if up infront of a judge?
  14. With the fact I have defaults I don't think it's worth paying OC as they will likely spread out my defaults. Guess il wait until they are all sold on and accrue my money for any options that come up. Il likely change my phone number and wait. Chase for CCA agreements before I agree to engage with anyone
  15. barclaycard has been sold to PRA Group. My intro letter from them came with the BC notification. my mistake it was just 1 so far. I will get this scanned as soon as i can.
