Hello, hoping for a little bit of advice please.

In 1991/92 I took out 2 student loans for around £1000 each I think, I cannot remember.

Over the years and several addresses I have deferred these loans due to not having a high enough income.

I moved to my current house 7 years ago,

today I received a phonecall from Erudio, who I had no idea about.

I never admitted that I was myself as I said to them I had never had any dealings with them,

she told me to google them and call back.

I have and now realise it is my old loan from SLC.

I have had no contact with SLC for 7 years,

so am I right in thinking it is statute barred?

If they call back

I am going to say if they feel they have any reason to contact the person they are asking for

then please do so in writing, that way I can deal with it

as I have no intention of admitting or doing anything over the phone to one of their call centre lot.

Any advice gratefully received!

If you have not paid anything or deferred within the last 6 years, then yes those old student loans will be statute barred.

Don't deal with these people on the phone. Wait for them to write and respond saying that the loans will now be subject to limtations act, so you have no intention in corresponding with them further.

We could do with some help from you.

Brilliant. I was hoping that was exactly what it would be. They haven't written yet which is odd, so assuming they do not have address details yet, so I will wait till the do, and then reply with that.

Thank-you so much

Claire

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

dca's are not bailiff's

they have no such legal powers.

all they are ever interested in is spoofing people out of money.

I got some from Lowells and Wescott written off years ago thanks to this site - it is truly the best resource there is on the internet for help with financial problems. Great help from friendly people :)

They called me today too (92-94 loans) -

- I couldn't clear security with them,

because my postcode isn't the one they had.

I told 'em loud and clear it was illegal for them to be chasing me for a statute barred debt,

and any further contact would be reported to the FOS.

Not sure what happens next,

as I didn't clear security and I'm guessing they don't have my address,

but the woman said that what I had told them had been noted on the account.

They called me again today, but I was out, no doubt they will call me tomorrow.

My only slight worry is that at the time I moved it may have been currently deferred,

and I cannot remember exactly when that was last done.

I know I have had no dealings with them in 6 years,

but if it had been deferred in the 12 months prior to that,

then it won't be quite statute barred yet.

I don;t think they have my address as I am sure they would write if they did,

so hoping that by the time they find it it will be definitely barred.

Or should I just say what you said, and see what happens?

Ignore them. Your address should be available to them from credit record searches, if they wanted to write to you.

in E&W all that SB means is they cant enforce in court or threaten court.

they can ask for payment

you can equally ask them to go away.
