Just wondering has anybody used UKDP Drainage insurance claims experts before. This company was recomended to help me with my claim against my insurance company due to a delay with the insurance company reapairing the burst sewage at my property.

 

My insurance company paid directly to UKDP who in turn appointed a builder to do the work as per the terms of the agreement signed with UKDP. The work was finished in sep 2013. 8months later there was a problem with the flooring creeking and hugely viberating any time you step on the flooring.

 

Despite every effort to get UKDP to get the builder to come and fix the problem, they have refused to do this and have told me that they were only facilitators as such l should contact the builder directly to resolve the issue. This is contrary to the agreement signed with UKDP. I complained to UKDP regarding this. My complaint was not responded to so l made my complaints to the ombudsman and now awaiting response.

 

What can l do??/

Yes l have but they said i agreed for UKDP to be my appointed rep and all monies were paid to them. They refered me back to UKDP as they appointed the builders.

Unless you agreed to change in your insurance contract to say that the insurers were no longer legally responsible for this issue, then they are still legally responsible per your contract of insurance.

 

Suggest that you write to insurers head of claims and ensure that the FOS include the insurers in the complaint.

Presumably, as with most loss assesors, a mandate to was signed stating UKDP were acting on the behalf of the OP, having the right to negotiate and receive settlement.

 

If this is the case, the insurer will probably not have any further liability here. It's much the same as settling with the OP direct, as UKDP are the appointed agent of the OP.
