NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I have had a letter back from Blemain, (I think it was written by a ten year old!). Of course disputing my requests for fair charges and all that.

 

I think the next course of action is Court. My local court is not now open to the public, so I have to go online for the claim forms.

Any opinions about using the 'Money Claim Online' service? This is an option as well as, I suppose attending court.

MCOL is your only option....unless you wish to submit manually through Salford CCMCC.

But why bother so easy through MCOL and you can also monitor its progress on line .

Hello Wungus

Today I am preparing paperwork and going to apply to court.

I haven't done it before as my husband was seriously ill with cancer and I looked after him.

 

I am apprehensive about going to the court, so trying to get all my paperwork together and the sequence of events clear again in my head.

 

But, I am determined to see this through, all the anxiety they caused us over the last few years. I want to do this for my late husband, get some justice for us both.

Also remember fielder we are better TOGETHER us all on here helping solve the whole mess up and justice done its never tooooooooooooo late to solve all errors and unlawfulness.

 

So i call you BRAVEHEART because you have always questioned the huge charges but never got answers back now you will finally see open doors of the real TRUTH.

I have just seen you on here so glad you come on recently to talk about court soon. :whoo:

Thanks Releasusall, you made me cry calling me Braveheart, I don't feel brave at all. My life has been turned upside down after the very sad death of my husband.

And thank you for the encouragement, it's what I need.

I don't have a date for the court yet, I am still going through the paperwork and trying to decide how to word the application for the court. I feel I have to get it right. So no pressure then!!!

listen you are going to be fine now,

i am so excited for you because its perfect timing ,as for paperwork you just do this .

 

once you have put all in order on day of court thats if you end up needing going to court and this dont end earlier you just say to judge.

 

I STAND ON MY SUBMISSION AND THEN SIT DOWN .

make sure you search and search on line for info ok

do this asap on all on blemain

you will be surprized what you find

tap in loads of things under company and write it all down )

 

 

as they say if you look hard enough or read others threads on here or other sites

I'm devastated and ready to give up.

 

I asked a solicitor who deals with consumer credit to advise me on this claim, solicitor tells me my potential claim is 'Statute Barred' time ran out in 2013.

And to possibly have the chance to take it to court I would need to pay a barrister to look at the paperwork at a cost of up to £1,500.

Solicitors fees of £500 also.

 

Money I don't have, seems unfair that Blemain can take my money from me, make my life even worse that it should be and when I try to get it back I can't afford the cost to fight them, because Blemain have taken my money.

Because the issue is statute barred, I have been to a solicitor who specialises in consumer law. Solicitor has written letter for me to send.

 

So ongoing! !

 

When I get a reply I will post on here.

just to say its easy to put your case together yourself,

believe me im no genius lol

but i seem to have the knack,

 

i just wrote from the heart and sent in vital evidence and also sensed to go and see people like dr, solicitor who had written to blemain in past and other new evidence i found on line too and my bank who had to deal with blemain few times.

 

I had to do a case over my son being bullied at school for court,

i did it and it went court and i won.

 

So please dont loose heart cos you may just find you can do it.

You can get a money claim form send it off with all your evidence old and new and they will send a letter back pretty quick i got reply after 11days).

 

Please give this a go

Had a reply from Blemain, letter says that they do not keep documents over six years because of Data Protection law.

 

So, I do not have any hope.

 

Although I do have many of the letters they sent to me.

 

Reading through another thread someone mentioned that the FSA fined Blemain for mishandling accounts from 2004 to 2009.

This is the period when I had my loan with them.

 

The fact that they were fined for their actions during this period, I may be able to use this to my advantage.

 

Not sure how I can use this, or who I can appeal to, court maybe?

Well, I did think that they do have the paperwork. Because I received a reply to my SAR not too long ago.

 

But I'm still at a loss as to how to proceed from here.

 

Would it be worth contacting FSA?

I am not sure they will help me, not really in their remit I expect.
