HI

Ive got a start date for a job for 15 hours a week ( 1st June). It is my first job since a major breakdown last year, ( suicide attempts, irrational behavior, [paranoia etc etc)

I am on ESA now since January 5th and have my assessment a week on Saturday.

However, do i tell them about my job offer at the assessment? I am terrified of people, being assaulted, being raped, etc

When do i tell the DWP, i have the form ready to fill in.

I need this job to help me back to my old self so i can look at getting back on my feet and getting back in to permanent work. However, without the extra ESA cash through permitted work i cannot afford to take the job. Silly as it seems, but i need it for my sanity.

Please help

I don't want to get into trouble but i feel stuck between a rock and a hard place

Also, what happens to sick notes if you are working permitted work?

Your face to face assessment and your proposed job are mutually exclusive. Health and Disability Assessments (Maximus) are unlikely to know about it and you're under no obligation to tell them. As you've not yet returned a PW1 to Jobcentreplus forget about the job until after your assessment. Only possible sticking point is if, at a later stage, the duties of your new job conflict with something you've told the assessor you've a problem with.

 

Given the circumstances you may want to delay return of the PW1 until you receive a determination about your employment n support. But don't leave it longer than early May cos you'll risk suspension of any benefit you're entitled to while Jobcentreplus approve your permitted work.

 

Permitted work or not, Med 3 (unfit) notes need to be submitted until there's a determination on your claim.

 

No rocks, no hard places, no trouble, if you follow the rules. ESA and permitted work aren't mutually exclusive. :-)

Thanks Margaret. No there isn't, I've never noticed it before though.

I've got myself all worried about it so I've signed off Esa. I start work 15 hours a week on Monday 1st June but can't afford to live on just that money. I will re submit a new Esa claim when I start. How can you work and still get stuck notes

The system with sick notes (fit notes) accepts that you can work; but may need adjustments to be made. The idea of peritted work does mean that you can try work before signing off completely, going into work, deciding it's not for you / you become ill again and you're then forced to then go through a brand new ESA claim again.

Thank you, so do i apply again before i start my part time job, like a week before???. My doctor and I agree it is worth a try at part time to get me back into full time employment and i think it will do me some good. I am cetainly not ready for FT employment yet but it is where i want to be in 6 - 12 months time.

I start on Monday 1st June so shall i call up ESA a week before and reapply. What do i get my doctor to put on my fit note with regards to not being too sick to work but not well enough to do full time yet.

My benefits if awarded ESA whilst working part time are £30.00 a week plus HB ( shared house £58.70 a week) which makes a huge difference to whether i can take ther job or not.

If we put your mental health issues to one side, which understandably can turn molehills into mountains; are you able to explain your concerns about doing permitted work whilst in receipt of employment n support? From what you've written I can't see that you've done, or were about to do, anything wrong.

 

Regardless of my rather sarcastic opinion about them, 'sick notes/medical certificates' have officially morphed into fit notes. A doctor's opinion as to whether;

 

The patient is fully fit for any work,

 

With reasonable adjustments, may be fit for some work,

 

The patient is not fit for work.

 

And #4 explains the rationale behind permitted work. The doctor doesn't need to write anything different to what was put on your last 'fit note'. Most, if not all, claimants aren't working when they first claim ESA so I don't know whether Jobcentreplus would pay a claim from someone who was already working part time. And even if they did, it'd probably take several weeks for a decision on the claim and if the work was permitted.

 

Best thing, if we can solve some of your concerns, is to reclaim ESA now with the explanation that closing your claim was a mistake cos of your illness. Then when the claim's in payment (no obvious reason not to pay it) submit the PW1. Cos of a recent legislative change you may get greeted with 'you can't reclaim for the same condition'. Remind the call centre, or write on your ESA1, that it only applies when a negative decision by Jobcentreplus ends the previous claim.

 

Any reason, that you know of, why Jobcentreplus were only paying you £30? Possibly savings, or a partner's earnings? If not, normal assessment rate is £72.40 or £57.35 if you're under 25.

I'll will call them next week. The reasing for the 30 pounds in Esa payment is because my work for 15 hours is over the minimum wage so I put the amounts into entitled to and that's whatsit said.

As for my fit notes, dooes my doctor need to say part time work recommended etc, as I understand your not insured if signed off sick!!

Right, this is how permitted work, whilst in receipt of employment n support usually goes; :biggrin:

 

Claim for employment n support on gounds of limited cpability for work. If the claimant's eligible for an award, Jobcentreplus treat claimant as having limited capability for work and pay assessment rate ESA pending an assessment of the claimant's functional limitations. Current rate is £72.40, or less for under 25s. Might be less if it's a contributions only claim without enough paid or credited contributions. Also, for an income related claim, if there's other income/savings.

 

Start permitted work. Currently, you're allowed to earn up to £104 per week after deductions for national insurance and tax. More than that will terminate your ESA.

( Sorry, I've no idea how the calculator got to £30 per week.)

 

A recommendation for part time hours doesn't really fit your situation. Gives Health n Disability Assessments too many ideas.
