Hi

CCJ was obtained by HFC Bank in 2007 - I paid judgement amount until 6 months ago when CCJ was 6 years old and removed from credit report.

A balance remains outstanding. Debt was sold to MCE who are now chasing via Mortimer Clarke.

 

Mortimer Clarke are threatening returning to court to obtain attachment of earnings etc from original judgement.

Do I continue to pay HFC at judgement amount? pay MCE? or neither?

did you ever SAR HFC and get all the statements

You can or just resume payments...what's the rough balance still outstanding?

I would inform Mortimer Clarke that you continue to pay as per instructions on the Judgment unless a change of solicitors ( civil procedures part 42 ) has been notified to you from the court.

 

CPR 42 only applies pre judgment CQ

Can I ask why you ceased payment once it fell of your credit file...any particular reason?

Hi made payment as previous and they have credited back into my account!

 

Who should I contact? Found original court paperwork.

 

Claimant is HFC Bank

 

Name and address for payment is Reston Solictors

you might have gotten your wish then!

 

as far as I am aware

if you don't start paying MCE once its sold

they have to get themselves substituted as the claimant

before they can enforce the debt.

Need some real clarity, please.....

 

Spoken to HFC Bank,

they are not interested and will reject any payment from me as they have sold to Phoenix...

...Phone the number they give, answered Marlin previously Cabot (or vice-versa)

they are not interested either as they have passed/sold to Mortimer Clarke Solicitors. Long conversation......

 

they want me to complete forms or attachment of earnings to decide how much I must pay....

 

respond no I have a CCJ against me....

 

they advise they have a charge against my property...

 

I advise they do not, I got it removed as I was not in default....

 

they confirm then that they don't.....

 

ask me to fax my judgment....

 

I ask why they don't have it...

...quicker if I send as they will have to apply to courts.

...I have not sent and have no intention of doing so....

 

they give me their bank details to start paying again (£5 per month) and also arrears (£35)

 

Debt is over £4k...

...CCJ doesn't appear on my credit file

and I will be 109 years old before they are paid in full.

 

Do I start paying?

 

 

Pay arrears?

 

I am more than happy to pay £60 per year to them until one day I will no doubt just decide to pay it off

or Ill drop down dead before.

That's interesting , thank you.

After Lloyds ' Horta Osorio was told off by the government for using fake solicitors SCM, debtors with a CCJ from SCM were informed of a new solicitor recently.

 

What are the rules if a claimant sells the debt and the new owner wishes to use a solicitor for collecting the debt ?

I have just received a letter from Mortimer Clarke saying their client obtained judgement on 23/08/2007 and as I have not made an arrangement to pay their wish to take action to enforce the judgement order by applying for an attachment of earnings order.

 

I stopped paying in January 2021.

 

Can they enforce? Do I ignore? Do I need to respond requesting anything?

so you have 2 CCJ's for the same debt?

goldfish was HFC (Cabot CCJ)

what was the other HFC debt (HFC CCJ)
