hi,

 

My first post and i'm guessing it's going to be pretty unique.

 

My parents split-up when we (3 children) were young & we were brought up by our dad in the family home. Obviously he paid the mortgage, etc.

 

Meanwhile our mother re-married and she has now got plenty of money but dad is broke.

 

The house is still in both their names but mum says she wants to transfer the entire ownership to my dad as long as she "just has to sign something" and it doesn't cost her anything.

 

Dad has agreed to pay all costs but doesn't think he should be actively involved as he doesn't think it's right for it to look as if he was pressuring mum into handling over her share.

 

When i phoned a local solicitor they said dad needed to do it but i agree with him, it might look as if he was forcing her to do it.

 

Is there a document they could both sign that we could then send away to be "legalised"?

 

Or ... ????

Hi and welcome to cag. When I moved to my present home I used a conveyancing firm and did everything by post. I wonder if that might work for this situation.

 

That said, I don't know who you and your dad worry he might be exerting pressure, but if your mum is willing it's really nobody else's business.

Thanks caro. Great idea.

I've had a quick look, via MoneySuperMarket, at a few conveyancing firms (just to give me a few ideas). I don't suppose you have any idea why some firms are charging twice as much for the disbursements as others do? Legal fees i can understand varying but i would have thought that the disbursements, for say selling a property, would all be the same (land registry charges, searches & stamp duty inc. VAT).

No idea I'm afraid. I can't recommend anyone but I will say that we saved quite a bit using a conveyancing firm instead of local solicitor. As you say, searches etc should be the same price.

Hello there.

 

In your place I would try the Law Society's website and the 'find a lawyer facility' that helps you find conveyancing firms in your area. That way you can ring and speak to them to see who you feel you could work with and question them about their fees and disbursements. Personally I would choose someone local in case you need to see them or drop off documents.

That way you can ring and speak to them to see who you feel you could work with and question them about their fees and disbursements. Personally I would choose someone local in case you need to see them or drop off documents.

While I quite see your point hb, we were amazed to find doing everything by post didn't slow anything down. In fact delays were due to local solicitors involved. Quite possible we were just lucky but I wouldn't hesitate to use this method again.

 

Always good to look at all the options so your point is well made. :)

Then your first stop would be resolving this with the Mortgagor (Mother is still tied) ...Land Registry wont complete transfer whilst there is an outstanding mortgage.

Never having done this before, I have asked my (ex-) mortgage company to send the Deeds to me. What does one normally do in these circumstances?

(I don't really speak like that).
