I have a joint Halifax account with my ex which is still open but not used.

I have highlighted £100's of charges in my statements (mostly missed DDs), going back to 2006. Can I reclaim these without his consent? If awarded a claim I would lodge the cheque in this account.

 

 

Also, we separated 2 years ago, have 4 kids , and £1,000s in debt in credit cards (paying an agreed £50 per month) , and unsecured loans (which are in my name). He contributes nothing to the upbringing of his kids, and I am left to pay the mortgage and insurance etc. do I state these reasons of "Financial hardship"on my claim letter, or just claim that I believe these charges were "disproportionate"?

What sort of state is the account in, is it in credit or overdrawn ?

Hi Plastered,

 

Bank account - If you are currently in financial difficulty (FD) and can show this on a budget planner, then you could try and reclaim current or recent default charges.

 

It's unlikely that you'll get any older charges refunded unless you can show that you were using an overdraft AND you made the bank clearly aware that you were in FD.

 

Credit Card account - If you suffered penalty charges, these can and should be reclaimed in full. Depending on the card issuer, you may also try reclaiming compound interest on the charges which could increase the amount reclaimed hugely.

 

Do you have all your old statements for the bank and CCard accounts.

It's unlikely that you'll get any older charges refunded unless you can show that you were using an overdraft AND you made the bank clearly aware that you were in FD.

 

Can you comment on whether you would qualify, according to my suggestion above, to try and reclaim because you said YES to both parts - ie you were using an overdraft AND the bank had been made aware that you were in FD.

 

If not, you may be better concentrating on :-

 

1. Making sure the bank know now that you're in FD and ask them to stop adding default charges and interest to your bank account.

 

2. Reclaiming the full amount of every credit card penalty charge you can find.
