vint1954..............thanks for the reply makes a lot of sense,in a couple of cases where i have sent SAR and still getting the run around will use the letter still one CCA to do in the new year will hold back on this until i get the usual TC response..........thanks again ...have a good Christmas.........Firstship

No problem, it's just a question of seeing and understanding the whole process. It pays to read as much as you can on here before you start, but basically:

 

1. Send CCA request

 

2. Put account into dispute if they fail to respond or issue a useless credit agreement.

 

3. Argue your points in writing.

 

4. Counter their points in writing.

 

5. Always have the last letter in their file.

 

6. Just deal with other points as they arise.

 

7. Send SAR when most appropriate to do so. There are many valid opinions on when this should be, but it seems most useful after DN and termination.

JOHNNYMITCH............HSBC asked if I would be good enough to arrange to discuss the matter with the local branch as they have very little detail regarding the account on file.Done this and was asked what I would like to happen to the account(the mind Boggles) my REPLY no signed agreement,no payments and I suggest the way forward is Declaratory Relief(your reply page 37 on this thread),you where right Question what is that........explained what this meant......cant agree to this at branch level will take it up with their Regional Office.....at least Ive got to use Declaratory Relief..to be fair the branch would like to see the whole issue settled and they felt this was probably the only answer.....Lets See......Johnnymitch thanks very much....FS

Hi..all......received a letter from HSBC stating as they after a long investigation,they really cannot produce a copy of the original or any details of the agreement,and under the circumstances they have instructed MCS to write off the debt,but however they will leave this on file.Naturally I am over the moon as it is in excess of £3000.Why do I have this niggle at the back of my mind......................Can the debt be sold on.....why leave it on file if its written off........why get MCS to write it off I realise they are HSBC........or am I just reading into it all things that are not there...............FS

keep that letter safe and if they do flog it on, send a copy to whomever chases with a polite foxtrot oscar.

As silverfox wisely says .....keep hold of that letter in a very safe place .. but I would say that's the end of it ... unless MCS are truly stupid ..... :D.

To leave it on file is possibly to leave the record of it on file ..... :confused::).

 

Also ,it may be better to wait until you get a confirmation from MCS that the debt has been written off...... I notice they say they 'have instructed' MCS to write it off .... and ,while MCS as you say are HSBC, they may just be tempted to try to recover this at their own instigation .

 

But I 'd relax and enjoy - I think it's a result ! :)

Was the debt defaulted and how long ago ? I think it remains on your file for 6 years

Hi citizenB,

 

 

the 6 years are up September 2015,

 

 

HSBC agreed that they would write off the balance (Midland Bank Loan) as a gesture of goodwill,

(won't bore you with the long story),

 

 

however they indicated they would probably register this as a debt on my credit file,

 

 

which they did and recorded it as a default,

 

 

which in turn means the amount is the same today as it was 5 years ago

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
