Help and Advice Needed Please re Halfiax

Long story .... in 1985 took out an endowment mortgage with the Halfiax

-I discovered years later that endowment was never set up to run alongside the mortgage

and brought this to their attention We used in house Halifax advisor and a solicitor to set up the mortgage.

 

The Halfiax have admitted an error was made and have offered small amount of comp. in the past.

 

The solicitors say they do not hold records that go that far back as do Royal Sun Alliance the endowment company.

 

After a lot of correspondence between ourselves and the Halifax we were told could not continue paying under the mortgage heading

and was persuaded via phone to change to Retirement Home Plan

- name only

- we wrote a letter saying we accepted this change as long as it did not change the term of mortgage.

 

We stopped paying our payments when we believed mortgage should have finished

- we now have letter to say taking us to court.

 

I have spoken to their solicitor who says is a complex case and has asked for all letters that we hold going back to 1985

I am just about to send them is this the right thing to do.

 

I have also made apt, with original solicitor as feel that this can not be our error

and that somewhere along the line should have been rectified.

 

Also not sure what to put onto the court forms
