      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just a couple of amendments chezt to make it a bit more concise if you want them

 

I refer to your very comprehensive letter dated (DATE) relating to my request for repayment of charges. I have noted the contents of your letter and I respectfully decline your offer of £xxxx as full and final settlement, and request, once again, that you return to me the total sum of my claim. I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary.

 

Thank you for your fascinating explanation of how you calculate interest. Unfortunately, there seems to have been some misunderstanding, as I did not request this. A full and proper account of how the bank justifies charging the penalty fees imposed is what would be more appropriate here, although I do appreciate that this is probably very difficult for you to formulate.

 

I also note your offer of a set of duplicate statements for £10. Whilst I appreciate that this is probably very good value, I will not require these, as I have always kept my own records, which you will see are sufficiently accurate for the purposes of my claim.

 

Unless your records and mine differ, I would be grateful if you could advise why I should order a set of duplicate statements from you, and whom exactly I would be required to produce these to.

 

I would be obliged if you could now refund the full amount requested within the 14 days as stated in my letter before action dated (DATE). Failure to do so will leave me no alternative but to begin a claim against you (in the County Court on (DATE)) for the full amount plus costs plus interest, and without further notice.

I trust this clarifies my position and I look forward to receiving your positive reply. You are reminded that there will be no extension to this timescale.

They didn't actually give me an amount, just offered to refund the difference between the charges & the £12 mentioned by OFT ... I couldn't be a**sed (bothered!) to work out what that would be so that's why I just said partial refund lol :rolleyes:

Well, I got off lightly there, I think. Scathing comments appear to have been set aside, seein' as I woz de Birfday Boy !! You guys were very kind.

LBA expires on Wednesday & rec'd another letter from RBS today following mine on 21st Nov - no reference to why I need to pay £10 for duplicate statements or responding to my request for them to supply how the bank justifies their charges (well surprise surprise!) Also no reference to my rejecting their offer - just quite simply ...

 

'TY for correspondence .... currently reviewing this issue & will cntact me again within 2 weeks (that's a shame 'cos I'm due to MCOL this on on Thursday!) to let me know how it's resolved or at least to let me know how they're progressing.' Also they thank me again for bringing this to their attention! :rolleyes:

 

Watch this space .... Hopefully I'll be getting my money soon!

Dear Ms Head

Thank you for your letter I received today dated 23rd November 2006 advising that you are currently reviewing my request for repayment of charges. Whilst I am pleased to hear that you are dealing with my request, I would like to remind you that I issued to you on DATE my Letter Before Action which expires 29th November 2006.

Therefore once again, I would be obliged if you could now refund by return the full amount requested without further delay. Failure to do so will leave me no alternative but to begin a claim against you (in the County Court on 30th November 2006) for the full amount including interest (currently standing at £xx.xx as of today’s date and gaining £0.xxp daily interest) plus my costs (for which the courts charge £80.00 for a claim of this value) and without further notice. I feel sure however, that you will not consider this a viable or cost-effective option.

I trust this clarifies my position and I look forward to receiving your positive reply. You are reminded that there will be no extension to this timescale.

Sorry I missed the opportunity you offered me to add some "snidey" stuff, but you did well to go ahead and print it in the end. No, I have to admit, that it seems "politely snotty" enough to me to do the job, mate !! Any more stuff (& thanks for waiting for me, anyway !!) would have been "gilding the lily" I reckon. Or should I say "barbing the nettle" ? Heh-heh.

 

Oh - and thanks for helping out P'O with the screen print sizing, mate. Poor sod must have been having headaches every night. Mrs K says "...so what's new ?" :D
