Today was the straw that broke the camels back. Got my monthly bank statement and I can't believe Scabby are going to charge me £80 for being over my overdraft by £1.54 I'm so angry.

 

So the dpa letter is printed out and signed and the cheque for a tenner is written out and both are stuffed into an envelope. I just wish it wasn't a bank (oh the irony) holiday so I get it posted.

 

In previous experiences how long does it take from you initally sending the letter to getting the result you wanted???

5th or 6th July - 2nd letter sent.

HSBC: 10/04/06 - Have to write DPA letter.

No no. I'm definately going to send it via recordered delivery.

 

I'm still fuming with the sheer cheek of them. I only get paid about £450 - £500 a month. :(

Actually, I know what you mean. We are on a low income and have Disabled Persons Tax Credit as a top up. I have just been notified that on 26th they are going to take out £140!

 

Oh well...another £140 to the holiday fund. :)

Will it hinder the process if the letter was not recorded delivery? My other half posted ours and forgot about this bit. I sent a PO as Abbey won't allow me a chequebook any longer. Will this be OK or should I start again? I have the counterfoil from the PO, obviously.

Should be okay, but maybe if you don't get the standard response after a couple of weeks then chase it up. With recorded they cannot say they haven't received it.

Take it into your nearest branch it will be quicker (see my post on branch procedures).

 

All you have to do is find a branch thats open till 4pm!!!!!!!!!!!!!!

Well the DPA letter & cheque was sent on Saturday via recorded. Now does the 40 days wait go from the date on the recorded delivery slip or the date they recieve it (by checking the royal mail website)?

Well here's a predicament.

 

Royal Mail have no records of my letter arriving yet my DPA cheque cleared and the £10 took from my account today so...

 

To find out the exact date it was sent off I have been advised to ring Royal Mail again on Friday.

 

Blooming heck. :???:

 

So since it takes 3 working days to clear a cheque for us Joe Publics It's probably safe to assume my letter arrived on the 19th of April. The 40 day curfew for this will be the 29th May.

Oh I've opened a new account with the Co-operative bank as well. I just went for the bog standard one (cashminder) which just comes with an electron card and cheque book and no overdrafts etc.

 

One day I will get my finances sorted I swear. :rolleyes:

Well Abbey's 40 days ran out 3 days ago and so far they've sent me bank statements for all of 2005 and 2006 even tho I asked for all information since Feb of 2002 which is when I opened my bank account with them so I guess I have to go by what I've got and multiply it to make up for the other 3 years they failed to give me the information of in my second letter.

 

geez.

I worked out th average annual charges and applied this to the years they did not provide statements for. I also reported them to the IC online - there's a link on the IC page.

 

IC have asked for further details.

 

If we all do this then the penny will drop eventually, I hope, about Abbey abusing the law.

did you state on your letter to bbey tht you had notified the IC also?

I am sure if you threaten to report them they will soon send them.

 

I think I saw someone sending another letter asking them to comply within 7 days.

 

Of course theres nothing to stop you sending an LBA for the amounts you know about and adding that you will be claiming the earlier period also.

It may be that you have the total figures by the time you are filing for court ?

I told them I was reporting them. I have since told them thet were reported. Bothered? Not likely - armour plated skin. They think they are above the law.:-x

Well I still didn't recieve the remaining bank statements I needed so I basically worked out how much it would have been with the information I had and divided it by the amount of months I had info for and then mulitiplied it by the number of months I was claiming for which gave me the grand figure of £888.23.

 

I sent them the 2nd letter on the 5/6th of July (I handed it in at my local branch) requesting this money back and also requesting the missing bank statements I needed within 7 days otherwise I was complaining to the information commisioners and still nada. So this week 19th/20th July will mark the 14 days since they recieved the letter and so I have to write that letter to the information commisioners anyway and write the 3rd letter to abbey.

 

I did state on the letter that I wanted to see the rest of the statements so I could know for definate if the amount I was claiming for was correct or not but like I say I've recieved nothing.

 

Bit cack really as I need some of the missing statements with regards to a dispute I have with NTHell as well. :-(

Oh this may be a compplete coincidence also but last week I did recieve a letter from abbey stating that they're going to reduce my student overdraft from £2000 down to £1100 on the 1st September (My claim is just £2 short - funny that).

 

So I'm guessing they have read my letter as the numbers are very coincidental. Just as well I was going to use that money to pay off some of my overdraft anyway. *shrug*.
