Sent SAR 17/09/06 or was it 17/10/06 cant remember but its under the thread "Zzeds journey"

 

Recieved letter from debt collector demanding that I call them in 48hrs to arrange new payment amount as I'm paying too little. (Debt is with a debt management programme as I was falling behind and getting deeper in D*D* with the charges interest etc)

 

24/10/06 Called debt collector explained situ with debt management and sending new I & E (income & expenditure)

 

27/10/06 Got letter from CitiVisa asking for ID and confirmation of address including a 4 page form to fill in + reminder that they WILL use the £10 fee for SAR.

 

28/10/06 Filled in form, attached copies of ID and sent off with letter to reiterate that payment had been made before...... Waiting to see

Well got the staments and put it my claim for just under £400, on 17/11/06.

Got the FOB off letter 27/11/06 but it seems a Citi are taking a different move with mine now.

They are apparently awaiting the results of anotehr claim to "establish the legal position" before proceeding with any claims. Until then, T & Cs apply.

We are currently awaitning the decision of the Mercantile Court of a case before it on the question of the legality of these charges and the a amount that banks may charge. This decision will hopefully establish the final legal position on the same. Once we have been made aware of the results of this we will advise our customers of the intended position. Until that time our T & Cs of business remain applicable

 

 

It states the usual trap that the OFT did not say that all such defaults are unfair: merely set a recommended threshold of £12 etc etc.

 

I think they are dealing differently with people here.

There is a case next week in London Mercantile Court marcopolo is the claimant - his thread is on here.

I would go straight to LBA and see how they reply to that.
