  1. HFC: So I had a rummage and came across my last failed attempt to get the PPI back of HFC in 2008. HFC rejected it on the basis that though i rejected cover for death, I accepted cover for accident, sickness or unemployment. They say that they explained this to me during the application and I signed up. Well, I remember this conversation as the chap who sold me the loan and PPI was an arrogant little hmm and he said no accepty no loany. [ATTACH=CONFIG]40156[/ATTACH] I had a lot on my plate then and I felt defeated by HFC and left it a that.:- Here's the crux: The form is clearly pre-filled as the tick in the box generated by a computer/typewiter ( see attached documents) [ATTACH=CONFIG]40157[/ATTACH] I have also found my original contract of employment which states that I was covered for sickness and would receive statutory redundancy pay depending on time served [ATTACH=CONFIG]40158[/ATTACH] I also have a copy of the letter I sent in 2005 asking them to cancel my PPI. (attached). [ATTACH=CONFIG]40159[/ATTACH] HFC never responded and the debt was handed over to a DCA who then agreed to go into a DMP though which the FULL amount of the loan, including the PPI was paid. I have already filed a fresh complaint about my PPI but as my six months (and some) is up to approach the ombudsman, should I go directly to the ombudsman or await HFCs response?

Hi all A few years ago I had some relative success with unfair charges and managed to pay off my debts I've started again this time with PPI and would like to pick your collective brain in the near future should the need arise I've put in 4 claims so far with Barclaycard, HFC, Barclay Loans and CitiVisa. I'm yet to pursue Egg and RBS My case is: HFC: Was gainfully employed when taking out the 6K loan.With sick pay and redundancy pay off guaranteed depending on time served. PPI and interest bumped it up to 9k (beggers). PPI was compulsory I was told, for the completion of the application. Was made redundant 6 months later but I had a job to go to so left with a hefty cheque of 6 months salary and started new job 2 weeks later.No lapse in payments in that time Paid a chunk of loan off and other debts and brought the balance to a manageable repayment amount with redundancy pay off. 2 years later I was made redundant again but no cheque this time to see me through and pay off my debts. Couldnt pay and tried to claim on PPI and they said eh.....NO Went into dmp and paid off debt over the next 4 years but.. Wrote to them asking them to cancel the PPI.. No response Anyhoo, dmp paid off the debt (and what was left of it at the time was PPI and interest only by my guess) in 2008 and HFC sent me a letter to acknowledge satisfaction of the debt (took a few hundred off when I was near the finish line) Case or not? (Claim in already, had account and old SAR statement but no agreement. Will look again for that) Barclaycard: Filled in the mailshot through door and got approved chop chop. Wasn't asked at all about PPI and got a PPI certificate soon after saying "my application had been approved" Hmm Kept it and tried to cancel when the wheels came off the wagon having tried to claim and they said NO.So felt well why pay if it don't to what it do??? Case or not? (No agreement but account details and PPI certificate with policy number available) CitiVisa: Mailshot again (fool) and sent non advised situ. This time I recall that form had "opt out" option only Had letter from 2004 acknowledging and confirming my cancellation of PPI after I tried to claim and again they said no (there's a theme here right? It's all true) Case or not? (letter confirming request for PPI cancellation in 2004. SAR statements but available from that time) Barclay Loans: Paid off loan early and the sneakies sent me a letter and cheque for £145, 12 months letter to say they had noticed that they had charged me PPI for the full term of the loan and were paying back the £145 as it was paid off earlier. I wrote back saying " can I have the rest if you please"? i'm yet to hear from them Case or not? ( letter acknowledging I'd over paid PPI with copy of the cheque. Account details etc available but no statements)

  6. I last sent them a SAR in 2006 and nothing happened. I've since mopved house and came across all my banks statements and then sent the an LBA. Still nothing cam of it not a squeak from them. Well it's 08 now and I think that I best get myself in line for the big pay off with the OFT diving in there and what not now. What i need to know is: Do I start again or just send a timely reminder of the letters i sent and the lack of responses from Barclays? Should I add interest to my calculations or just send the letter as per the original claim? With the OFT court action in infancy, is it worth going ahead or waiting till they give us a signal?   7. Hi guys. I took a loan out with HFC in 1999 for 7800 of which including interest and the PPi it worked out to be 11800 in the end. I ran into some difficulty a few years later and made an arrangement to pay off the loan, so long as the interest was stopped (which the did). I was told to cancel the PPi which I did (in 2005/May). I have only 1300 to pay as of this month but would like to get rid of the debt sooner if i find that I can claim the PPi payments back. I am yet to look at the documents (i have the original contract) some i'm not sure of the facts. The last time I tried to reclaim charges, HFC completely blanked me and I gave up. With the PPi I wount be giving up easily at all. What I need to know is what the way forward should be with this claim. do I just fire off the SAR nad if so, do you guys have a template for PPi claims?
  8. Oh, i also have the original contract i signed with HFC at the time detailing all the information including the true cost of the loan + PPI. The debt is not quite paid off just yet (nearly there) but is being managed by a third party. I'm down to the last 1500 but i strongly believe that this is just the PPI that's left. As i have all the details, do i need to send an SAR or do i just kindly asked for the money to be returned
  9. Hi guys. i wanted to know if anyone has dealing with HFC? I had a loan with them for £7800 and ended up with a total of 11800 after the PPI. When I was made redundant I managed to get a job asap and moved on but fell into difficulty some months later. the bill is now paid and i need to know if i can reclaim the PPI I paid on that loan?

  11. Hey guys After sending my LBA i got a mystery call a few minutes ago from MINT/RBS customer services regarding my complaint. Wanted information of my complaint etc adn I did not play ball. Apparently they are doing a survey on customer dissatisfaction so I said naah, can't do, wont do don't wanna talk.   13. Well I have sent the LBA this very afternoon for Mr Raja and will see what direction the case takes over the coming weeks. Prior to this the Prelim Letter had been all that i had sent which drew that response. Thanks again guys for the gee up as i think I needed it here. Aluta Continua

  15. Well?????? What happened? I got the same letter in November and have been tailoring your initial response to Mr Clibbens so i can try get some headway. They only told me of a Mercentile case and I should wait till they had got a reponse after the outcome of the case. Was about it jack in but the recent balance (considering how much i have paid off and the original limit) got the juices back and am ready for another round and more..... review:

Ey-ho Been away from the PC for a while and I mean a while but I have some challenging news from RBS. 27th November I recived the following letter from a Mr Waseem Raja: Taken aback, well, i actually coward back into my shell and have continued making payments to the debt recovery plan as normal (never did stop). But I had a look at the balance again and these fees add 8 months of payments to the balance and I'm really aggrieved by this. So help is needed as to the direction one must take. My aim is to reduce/remove all my debt with my creditors but they are not polaying ball with the charges here:mad:

  20. So it all began in October with RBS and juddered to a halt on 27/11/06 when I got a letter stating the following: It goes on to say that they hope this clarifies the matter blah blah blah. Clear as mud right now. They have followed the OFT recommendations, have paid out to others but are refusing to do so this time? Why??????// Can anyone help what with guidence regards the way forward:-x
  21. Well got the staments and put it my claim for just under £400, on 17/11/06. Got the FOB off letter 27/11/06 but it seems a Citi are taking a different move with mine now. They are apparently awaiting the results of anotehr claim to "establish the legal position" before proceeding with any claims. Until then, T & Cs apply. Please have a read and get back to me: It states the usual trap that the OFT did not say that all such defaults are unfair: merely set a recommended threshold of £12 etc etc. I think they are dealing differently with people here.
  22. Hi guys Been busy for a while but I have updated my signature to detail the progress of my claims. I have sent in all bar one and that is Barclays Bank as they are YET to respond to my S.A.R - (Subject Access Request). Read the letter again last night and it appears that they have passed on my request to the "department that deals with SARs". The 40 days isn't yet (10 to go) so I guess they have me there. I have ALL my statements for 2001, 03-05 but one year missing (02) and as I was averaging £200/year in charges, I thought I would wait till i had them all to start. Still the waiting.......................
  23. Hi guys Some news on this one. Got a letter 03/11/06 stating the usual I have seen on this thread. Basically here it goes: "Putting the above to one side, as a goodwill gesture and without admission of liability, I am prepared to credit your account with the difference between the charges that you have incurred and the £12 fee recommended by the OFT. this would amount to £128" The usual blurb goes on. It seems that most have accepted this as a partial offer and gone on to purssue the rest. I'm seething here as they not only pushed me into debt but added a default to boot on my name. What next, I hear you say? Read a little and prepare for the next stage to claim the rest. Please point out anything I may need to get to grips with for this claim... 1/2 down, 3 3/12 to go. 8-)
  24. sorry guys. Started a new thread by mistake and can't delete it Ey-ho A result of some sorts. Got the schedule of charges fro HFC and it seems they have charged my account £320 under the title " ADMIN.FEE.ASSESS" Can one claim these back? Their letter states "Although many of our systems are automanted, a "manual intervention" by HFC staff may be required in a variety of situations including; account opening, dealing with correspondence or telephone calls, and from time to time during account administration." One Lisa Bond has penned the latest missive and given a phone number to boot Please advise as to whether these are claimable if there is such a word??
