exactly what you have been doing.

 

red is just another bloke in the same office

 

he sits at the next desk from the last bloke that sent you a letter

just that he has a different coloured skirt on.

 

its all 'meant' to spoof you into thinking this 'is getting more serious'

 

when in all effect, all it is is another leterhead in the same printer as last time.

Had yet another letter from Lowell today. It says

 

"They are going to escalate the debt to Red Debt Collection Agency"

 

"Red Debt Collection agency will assess your account, credit file and your financial commitments to make a recommendation on how to recover the outstanding balance. This could include taking legal action or issuing a statutory demand which if remains unpaid can result in us petitioning the court for your bankruptcy"

 

Im worried about this letter any advice? Please :(

Don't worry... They do this to make you feel it's got more serious when in reality it's just the next desk along...

Hi everyone

 

I have decided to send a SAR request re this alleged debt. I was just going to ignore them but the constant phone calls from different numbers is becoming ridiculous.

 

Because Lowell now own this debt, do I send them the SAR or do I send it directly to HFC. If it's HFC could somebody please give me an up- to-date address.

 

Secondly should I send a CCA request to Lowell's?

but the CCJ is not on the public register part?

I sent a prove it letter to Lowell. They have acknowledged my complaint and stated the alleged account is on hold. However, they are asking me to confirm my address and DOB. Do I have to do this?

they shouldn't be issuing threats when they are not sure if you are the debtor...amazing!!

Hi Dx

 

You say that Lowell's have 8 weeks to reply to my prove it letter.

 

However, in their complaints procedure it's states they will endeavour to resolve complaints within 4 weeks.

 

They also say that if it goes over 4 weeks they will inform me on their progression.

 

The complaint is now almost 5 weeks and I have heard nothing either way.

 

Is no news good news?

They have sent me a signed credit agreement and a series of computer generated statements.

 

I will try and upload the credit agreement and one of the statements tomorrow.

I can't believe it :sad:

 

Ive managed to upload the files.

 

Please could you take a look and give me some advice on what the next step should be.

 

Lowells have given me 28 days to reply.

 

I may be clutching at straws but there are two different account numbers on this

and where my ex and I signed it asks for the date.

 

It appears that we did not date it and instead my ex had signed there?

There were a number of computer generated statements, the credit agreement and a covering letter from Lowell's. Yes it was a consolidation loan. I'm not 100% sure when the last payment was maybe 3 - 4 years and I have not acknowledged the debt since then. The statements do not appear to show when the last payment was?
