Formal Demand for Payment letter from BC

I have, like many on here received a letter stating they previously issued a default notice

and after 5 years, they now issue a FD.

 

They also wrote;

They intent to inform CRA's of default (dating back to 2009)

 

Legal proceedings may be taken against me if I do not make a payment agreement.

 

I requested a CCA back in 2009 and was fobbed off, and

 

since they haven't come up with any signed paperwork or CCA.

I then ceased making payments.

I have received no correspondence since then

 

So why now?

 

They worried about it becoming statute barred perhaps?

 

What would be the best way forward here?

Have you been in comms with them over the past five years?

 

If so, it's a bit like giving a dog a bone, it will always come back.

 

If they haven't supplied you with a CCA then have you told them that you dispute this because of their failure to supply one?

The letters they send are standard template missives, spat out by a computer with no human input at all.

Yep, I have done all this, back in 2009. Had no communication from them since!

Is this with the same outfit as in 2009 or has it been banded about and passed from pillar to post?

 

Did you tell them that they have failed and sent the above letter?

They say they have provided the information but they didn't.

What do you mean same outfit? I haven't had any DCA contact or anything, this is the first I've heard from them since 2009, out of the blue x

What is on your credit file regarding this?

 

By same outfit, I mean is this the same DCA now that was chasing you in 2009?

 

If it's a different one then that is a good sign!
