Whyte and co - pcn fine.

Hello. Whyte and co are dealing with my pcn fine (Newham Council).

 

While I do not deny I need to pay this,

their charges are somewhat dubious.

 

They are charging £175 for ATR, even though this was their first visit.

 

They now insist this was their third visit, which I do not think is true.

 

They also say they do not need to provide evidence of former visits or letters sent (None received).

 

Is this true?

did you get the letters direct from the council first

Sadly, most bailiff companies are interpreting the fee scale in such a way so as to ensure a significant financial advantage and this is mainly achieved by the application of an ATR fee. This should not be charged until a third visit. At present 7 local authorities in London are subject to complaints to the District Auditor regarding ATR ( and other ) fees.

 

I would never suggest not paying purely because with PCN enforcement the bailiff will merely clamp or remove the vehicle. Many times it is better to pay and to make a Formal Complaint to Newham.

 

Is there a reason why you failed to pay at the NTO, or earlier stage? I am trying to ascertain whether you have grounds to file an Out of Time witness statement.
