Hi

After a couple of years struggling to pay off my wifes Argos account I finally paid the last payment last week, balance is now zero.

 

It was a struggle which was not helped by the countless letters and phone calls reminding me that I was in debt to them.

 

Today I received a letter stating that because my credit worthness as gone down they are raising the APR from 29% to 34%, i can opt OUT of the new interest rate but if I do OPT OUT the Argos card will be cancelled.

 

I,ve been thinking about this today and it has got my back up. I now want to send them a SAR and claim back the late payment charges, there isn,t many but I feel that it`s time for me to start sending them letters reminding them they owe me money.

 

My questions are:

1. Can I claim these late payment charges back?

2. If I can claim charges back can i claim 29% interest?

3. Are there any threads about anyone claiming charges back from Argos, i,ve had a quick look around forum but can not find any?

Hi

 

I have merged your two threads. Best to keep to one otherwise help will end up being spread over two threads and thus duplicated.

 

These are deemed as unlawful penalties and yes you should look to claim them back. The process will be the same as with a credit card claim and you should be claiming interest at least at the rate they were charging you.

 

You may need to take court action to get them back but see what their reaction is to your preliminary reclaim and take it from there.
