In many cases they know the agreement won't be enforceable. Early CapOne agreements are very unlikely to be enforceable which is why neither CapOne nor Lowells or anyone else they sell it to, or instruct to collect, won't provide the agreement.

 

So you have to challenge them.

 

However, to really help we need to know who the original creditor was.
