      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What is the case if my Wife placed an order online and filled an account application in online for Littlewoods Catalog? She has also never signed any agreement etc? They sent the goods, and she has had this "Account" for a while now... about 4 years she thinks.

 

Sorry Martin i didn't notice your post! I'm sure I've read on here that online applications still class as a contract of some sort ... not 100% sure on this praps you ought to post this as a question on a seperate thread & see if you get a response :)

(section) 14. - (1) If a court is satisfied on the application of a data subject that personal data of which the applicant is the subject are inaccurate, the court may order the data controller to rectify, block, erase or destroy those data and any other personal data in respect of which he is the data controller and which contain an expression of opinion which appears to the court to be based on the inaccurate data.

 

The data (the total amount in debt defaulted) was inaccurate, therefore you can request the Judge to order it to be removed. As for banking codes etc, they don't apply....concentrate on this argument in your letter, re-work it and post it again.

I'm not sure, it might have been TideTurner, was saying that sending Recorded to these firms is just pants :rolleyes::D , as they have sacks of mail sometimes, and whole bunches of Recorded's. They often just give one sig for the lot, and the postie just doesn't bother entering the trackback details in for each & every one. It's a [problem], 'cos they get a quid for each one of those Recorded's in the bunch.

 

He recommends just getting a Certificate of Posting is good enough. Apparently proof of posting is good enough for the courts. After all, they just use standard 1st class post, don't they ?

 

Getting somewhere at last, tho' Chez. Excellent stuff.

Yeah d'ya know what Bill - i'm considering doing that you know 'cos at least u don't worry about it not getting there IYKWIM! It's not 'actually' costing me owt TBH as when I took redundancy from my job b4 me lil muffin was born (long story but it was fun n games!!) I made sure most of the stamps were cleared out n shared them between myself n the others ... sorta an unofficial part of our redundo package to help look for other jobs! :rolleyes: So I've loadsa stamps to cover the postage ... but that's not the point eh!

Good on yer, mate !! I've been redundo'd twice and they tried to do me out of dosh both times.

 

Yes, we all have to arrange "insurance" don't we !! ;)

 

Mine was the same - they were taking 'advice' from a so called professional consultant who was hired as 'the hatchet woman' who just so happened to be next door neighbour of the MD (:rolleyes: ) AND who it was rumoured was fired from her previous job for giving bad advice to a company!!! Anyway, luckily I had family legal protection on house insurance & the advice I got from them was FANTASTIC! They told exactly how to go on as it was a strange situation as I was Pregnant, & due to go on maternity leave with a pre-arranged agreement with my boss (who was the son of MD & also made redundo - yeah good eh!!!) & they said they didn't want to keep the agreement.

 

The best bit was actually when they sat in a grievance meeting & told me they could cancel the arrangement I already had as although it was part of my contract it could be cancelled as it hadn't yet started & the example they gave was that if they had offered someone a job & decided they no longer had a position for them that they could just revoke on the job offer

 

... my reply ''Err actually NO U COULDN'T!! - You can't cancel a contract that hasn't actually started!" They played right into my hands as that was the example my advice lady gave me to explain why they had to give notice of termination on that part of my contract then I could consider unfair termination of contract. Few days later they served notice of termination to that part & gave me FULL Notice period on it paying me that rate untill it expired ... little did they know they woulda only had to give me a weeks notice on that part as it was new ... oh dear! :rolleyes:

 

So with their help I managed to get a few grand which I wouldn't have got which kept me basically going on full pay more or less untill I started to look for another job!

 

Anyway, long n complicated story n ur probably asleep now:D
