Hi guys ,my name is Bart im selling on ebay designer clothing.

Last friday i get letter from Palmer Biggs to pay £1,000 for selling fake superdry and using superdry word in my listing. Thing is this is authentic Superdry and i have all paperwork from biggest UK stock clearance company.

I confirm in Superdry shop t-shirt are 100% real. I little bit panic now because i'm not English, don't speak English very well, but i have two shop on ebay and selling lot.

Should I pay to this company £1,000 plus sign all papers about my sales, suppliers, and commit to not use Superdry super dry etc in my shops. I don't know what to do .

regards

I think the general consensus is that you don't engage with them. I am sure you read on the other thread, that this company scours the internet and especially ebay looking for victims.

It would appear these are speculative invoices and the advice is not to pay them and certainly don't sign any of their paperwork.

Please, please do not telephone them either.

PB Legal are specialist 'Intellectual Property and Business Law' solicitors and are known to be very persistent and litigious so care is needed when dealing with them.

Who do PB claim is their client?

Because you are a single dad with a couple of kids doesn't mean you have to bow to them.

It is up to them to 'prove' that the stock you have is counterfeit and not for you to show they are genuine.

A demand for money or else is blackmail and should be reported as such.

They know that if they send out enough letters, some of the letters will land on the door mat of a person that is selling counterfeit product and will pay up. So they are just trying it on and you should do as suggested above and that is to send a bill them for all correspondence.

As you have genuine articles, their claim could be libellous, they are certainly defamatory.

I don't care what their name is and if they add 'legal' on the end to make themselves more scary, you mustn't pay them until they give you a breakdown of where they got this £1,000 from.

Everyone who sells on ebay who they say are selling non original products aren't due £1,000. How do they know how many you have sold, how do they know how much profit you have made.

They know that if they send out enough demands, just like the private parking companies, some will pay up without question.

This really is just an arbitrary amount, it's the same as the Davenport Lyons fiasco where they demanded £500 from thousands of people accusing them of downloading copyright material, some of those they accused didn't even have a computer.

In the above, they withdrew all their court suites before it got to court because they knew they couldn't prove anything.

Certainly don't pay them before Christmas, you enjoy that, and don't be bullied by them.
