i had a letter pushed through my door when i got home late yesterday

saying about a final notice for 373 and

he would be returning later this week

 

i think its for the remainder oof a court fine for tv license which i thought had been paid 2 years ago

 

i have had no thing from court before and no final steps notice etc

or any letters from marstons

 

can i get a stat dec from court

 

how do i go about getting one of these

 

 

am worried sick

 

i have a mentally sick husband

2 children under 5

and a pregnant daughter as well

As far as I know the statutory declaration is a standard form at the Magistrates that you can complete and swear in front of Magistrates. You just state that you have not received a further steps notice in relation to x matter. You need to go to the Magistrates that are dealing with this fine.

 

If you moved and stopped paying, Magistrates may not accept it.

i havent moved or anything do i ring court frst and what do i say to baliffs if they come today x

 

Is there any reason why you cannot go down to the court this morning ?

 

You can phone them first if you wish,

but from what I hear,

it is sometimes better to just turn up.

The court staff on the phone, will tell you to deal with the bailiffs.

 

You need to get this sorted and then the bailiffs will be called off if your declaration is accepted.

 

Otherwise you risk the bailiffs coming back, making a scene, forcing you make a payment.

 

Because it is a fine, the bailiffs can force entry if you are in, but this is usually only at last resort.

It may well not be possible to get a Statutory Declaration agreed.

 

A Statutory Declaration must be filed within 21 days of becoming aware of the conviction and as such, the Stat Dec must be filed within 21 days of the date on which you had been made aware (of the fine).

 

In your case you have stated that you had a TV licence fine and that Marston Group may be enforcing the remainder of the fine (which you thought that you had paid off). If so you would have difficulty getting the court to accept a Stat Dec. If you had moved address and a Further Steps Notice had been sent to the previous address the court might agree to consider the application but sadly have not moved and the court will very likely tell you that that send a notice to you.

 

I would suggest that you call the court asap and then post back.

 

When you post back can you provide a few more details regarding the "vulnerability" of hubby.

also might be an idea to go onto your online banking site

[if that's how you paid the fine off?]

 

you should be able to easily search there to find the payments

or

atleast download the relevant bank statements proving or not!

you did make the payments.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
