A new Question.

 

After a long bout of Letter Tennis with Lowell Finance/Portfolio regarding a debt purchased by SAV Finance from HFC for a defaulted Benificial Visa card

 

I got a letter saying :-

"After reviewing the account, we are prepared to take a commercial view in relation to this matter and as a gesture of goodwill

and strictly without any admission of liability, we are prepared to close the account and write off any outstanding balance. "

 

This had been preceded by a letter which contained

"After liaising with SAV Credit Ltd in an effort to obtain this document (credit agreement) we have been advised that it is no longer available ...."

 

These letters came in may 2011 and I filed them under RESULT!.

 

Well after reading a large number of threads on this forum I thought I would dig the bundle out and review it.

 

I found that there are at least 15 sundry charges of £12 each over most of 2008.

And on very interesting entry marked 'Card Protection' for £15.

 

I have never taken out PPI as it was useless for me (I was MD of limited Co. and as such could not become unemployed unless the company folded,

even if I had no contract work / income)

 

Now Beneficial were owned by HSBC so presumably a SAR to them would be a start.

 

Now the question.

Does the panel think that I am safe to pursue this without the possibility of this can of worms being reopened by Lowell.

 

And also do I stand a cat in hells chance of getting some cash, not going to bother if Lowell's get the cash as the debt holder.

Only 2011 since closure I would not like to think of you prompting them to attempt producing a recon and starting over again.

 

If I wait till it is SB will I still be able to make the claims, who would get the money?

They can offset against the debt SB only means that they cannot enforce via the courts, but the debt still exists and remains payable.

In that case I will forget it as I am convinced there are no regular PPI payments only late and over limit charges.

 

I agree if your'e sure there is no PPI.

Thinking about it you are probably correct, I did have such a policy back then.

this is your CPP thread on the HFC card

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
