Hello,i've been married & living in Germany for about 4 years. I left behind

at reasonable bank loan debt in Oz for which I could'nt make payments for

since i migrated over to Germany. My wife wants to go back to holiday in Australia

soon, and my question is can they take my Passport off me and not let me leave

Australia to come back home to Germany?

In the UK debt is a civil matter and they couldn't take your passport unless a criminal matter had occurred.

 

It isn't the same for all jurisdictions (for example, one can be imprisoned for debt in some Middle East countries) .

 

So, would you be better asking this on an Australian based website, rather than a UK one?.

Australian law is based pretty much on UK laws, so debts are purely a civil matter. No issue to Australian authorties, only the bank concerned. If you are still using Australian based credit or debit cards, you may have difficulty in using these in Australia.

Thanks for the reply's. Yeah, I'm just worried as i've read it these matters it could have gone to court

in my absence, & they say then, it becomes a criminal matter! I can't find any direct proper info on Australian forums?
