Hi, My partner took out a loan with blemain some years ago. and she kept telling me it was almost paid up.

It is in joint names by the way. My partner told me that the remaining balance didnt add up on the statements ,but she cancelled the direct debit when it was due to end. We then got letters from them saying wew owed another £2,000 ..aprox.

 

She phoned them to make a complaint . They said it was for the insurance Which they took out on our behalf.

I remembered then, that they asked us to get the insurance on our house to have them named has an interested party.Or whatever. Which we did and posted them off every year. They are now saying they never recieved any of them , which i dont believe for one minute. So it seems we have had two insurance policies on the go.

 

We cannot believe what has happened ,we seem to get mail from them no problem. yet they dont receive it from us.

We have never missed one payment to these people . Please can anyone help us... thankyou . We really cannot afford to pay any more.

 

Does the guy who runs this company ...run the country.

SAR them. Click the word 'SAR' for more details. Also, STAY OFF THE PHONE. Everything from now on is to be done in writing.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Do you have copies of your policies for the period in time or can you get a letter from your Insurance provider to say that you were covered for this period.

 

If so, then I don't think they have a leg to stand on.

 

It is hard to believe that letters sent every year to them, didn't arrive - presumably they were never returned to you ? In which case they are deemed delivered.

 

Make a complaint to their Head office - provide proof that you were covered for that period of time, is what I would do.

I am in a battle with Blemain and I am taking them to Court.

 

The first thing I think you should do is request a SAR.

 

I would not be at all supprised if your loan was irresponsible lending in the first place

Thankyou to everyone for your help... My partner says she has all related documents from our insurers ,with blemains name on them . And also she had made a complaint ,they just sent us a letter back saying we have to pay and some paperwork with there costs and charges on them.

 

She did not send the copies for the insurance docs ,because she's done it twice already, and they never receive them.

 

Can i just add ,,we really havnt time for all this nonesence ,we have 5 children one of which is 8 month old.

 

My partner is finding it hard to get involved its so ridiculous, and in a way i feel the same.

 

They are wasting our lives for their greed.

A subject access request is a request for ALL data in respect of your financial relationship with a company. It is a LEGAL request and the company has 40 calendar days in which to comply . There is a statutory fee that needs to be sent with the request of £10.00.

 

If they do not comply within the 40 calendar days or do not comply at all without very good reason, then you have the choice of issuing a claim against them for non compliance or you can make a complaint to the Information commissioner.

 

There is a draft letter in the CAG library - top left hand side of the screen highlighted in green.

 

I always recommend that people send this particular request by Special delivery and to their Registered/Head office address.

Every letter you send to them send it by signed for delivery, or email this proves the day they received the post, if you dont they will claim they did'nt receive it, this firm cannot be trusted. They know how to bend the rules and laws and do not give a damn about loans being paid off, they will try to rob their customers for as much as they can get away with, challeng and question everything
