Mackenzie Hall, default and incorrect spelt name

Hi,

 

I have just been onto Experian credit file and seen a default from Mackenzie hall for a debt i had with QuickQuid. Now when QQ lent me the money spell my name incorrect. Now the question i have is:

1) if i was to pay the Full Outstanding amount can i get the default removed

2) Is there anything i can do about them have spelt my name incorrect? e.g. they have an extra A

 

The reason i ask this, is that i have found my dream job, but they require a credit search on me, so i need a clean file.

 

Is there anything i can do, please help.

The company is obliged to record details accurately on credit files. So if you defaulted on the loan, then sadly they are allowed to mark this on your files.

 

I would think that you would need to speak to both the original creditor and Mucky Hall to ask them to correct the spelling of your name.

 

I do not think they would remove the default or the entry if you were to repay the loan - however, if you don't pay it, then they will continue to record the default. Once fully paid, they will mark your file that this has been paid.

I would check with the CRA to see if QQ put the Default on your file, or if Mucky hall did. Only reason i say this is because DCA's have been known to enter one off their own back. It's rare but worth checking out, especially if you havent seen QQ put one there before.

Hi,

 

Thanks or the response and sorry for the delay in replying.

 

On the 9th July I contacted McKenzie Hall and spoke to a lady who agreed if I paid the full amount outstanding they would remove the default. Now today when I rung up and spoke to someone else to pay the amount i agreed with the lady, i was told no they wont remove the default, just update to a satisfied state, which is what it currently it. Now going back to renegadeimp question "I never saw a default from QQ" the default came from Mckenzie Hall. Does anyone have any suggestions on how i progress this?

Mucky hall most likely inherited the default and updated it.

 

Regarding the promise of removal, I bet they said it on the phone and not in writing. This is their usual trick to try and get your money. You pay them and they deny saying it just like they are doing now.

 

You need to stay off the phone and keep everything in writing.

Cheers for the advice. Today i am sending them the following letter:

58 Portland Street,

Kilmarnock,

Scotland,

KA1 1JG.

 

Date: 24th July 2013

 

Dear Sir or Madam

 

Account number - Mxxxxxxxxx

 

After recently obtaining a copy of my credit file from Experian I was concerned to note that your company has placed a "Default" notice against my name.

Further to this I have not recollection of ever receiving such a notice, and I therefore require you to substantiate this data at your earliest convenience.

1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit). Your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee.

2. You must supply me with a signed true and certified copy of the original default notice

3. Any deed of assignment if the debt was sold on

I would request that this data is provided to myself within the next 28 days, if you are unable to provide this data then I must insist that it is removed from my files as unsubstantiated.

 

Yours faithfully

 

 

Lets see what they say, hopefully i can force them to removal the default.

If you are requesting a CCA, then they get 12+2 days, not 28. You wont get the deed of assignment either as it is confidential business information. You can however ask for the NOTICE of assignment.

Getting defaults removed is very difficult and it seems like this one was justified. I don't think you'll get anywhere with this.

 

Also, your entire objective is somewhat flawed as payday loans are considered negative by most lenders. In other words if you need a squeaky clean credit report, even if this is shown as satisfied, then it may be frowned upon by your potential employer. A lot of people have been denied mortgages because of payday loans, even ones paid back in full and early / on time.

 

Also, what do you propose they replace the default with? They can't show your account as "up to date" the entire time as that isn't the case, so they'd probably just replace it with a string of missed payments or something.

I would ask the CRA for the history of the entry. See who actually entered the original default.
