Hi all,

i have a flex account,

i have had charges totaling over £400 in the last 9 months,

 

Now i hate DD and SO and try to avoid them and pay by cash or card wherever possible.

 

Now i have been charged a few times for a unauthorized overdraft which is mad as ive never had one, i dont have a overdraft or a reserve limit.

If i go to make a payment by card and thers no money the card declines, simple.

 

If a DD tries to come out and thers no money it gets returned same with SO,

nationwide have never honored a payment that has taken me overdrawn,

So in essence i cant go overdrawn.

 

One day a payment went in a 2am and i made a card payment at 8am, when it showed on statement it showed i made the card payment 1st

then the money went in later

 

so for x time i was overdrawn,

 

i know i wasnt and when i tried to explain this is impossible with my account nationwide didnt give a crap,

 

Ive also had where i have not had enough money for a DD payment to be made so thats a £20 fee and then ive been charged another £15

for having a unauthorized overdraft even though i didnt as DD was returned but the £35 in fees has taken me overdrawn to which i get another £15 unauthorized overdraft fee.

 

Its a vicious circle and it cant be right. whats can i do.

 

Nationwide simply dont seem to care

Hi Everyone,

 

in short i sent a complaint to Nationwide regarding charges over the last 15 months, Totalling £465

i told them i knew the BCOBS and felt i was being treated unfairly.

 

They sent me a income/outgoings form which they said i must complete for them to consider a refund in charges, so i did.

 

I sent the form back 10 days ago,

 

i know they have it and have had time to look through it,

 

what should i do.

 

Sit and wait and hope a reply or letter comes,

call them up,

send another message asking for a update or will this just make them slow down even more.

Update,

 

i sent a friendly message via online banking asking for a update on Wednesday and

today received a call from Nationwide.

 

They have not received my income/expenditure form apparently.

Well i sent it back (with other documents) in there own Free post Envelope and did get Proof of Postage from the PO.

The lady then said we can do it over the phone if you like,

i said i wasnt happy with doing that as its quite complex hence why i returned in writing and have the POP.

 

She then said ok well if we do it on the phone we can look to refund the last 3 months charges,

i said wo wo wo 3 months i have nearly £500 worth of charges over the last 15 months i want back,

 

i then preceded to say the sort of charges i was getting were overdraft charges when its impossible for me to go overdrawn.

 

The lady told me, i can go overdrawn if a charge comes out,

 

Now isnt it illegal to place a charge on a charge, so a £20 charge takes the balance into -£17 so they then give another £20 charge.

She then just kept banging on about Nationwide Policy and t&c's bla bla.

 

What is my next step, to send a LBA and take them to CC, im furious with them now.

Can you advise what the LBA should say, and the costs involved of starting CC action, am i likely to win, will the bank cave in and settle before court.

the charges are [civil] unlawful not [criminal] illegal

 

it might be better if you just dump NW and go say with the co-op

you can open an account online.

 

there are details upon the lBA etc in the library tab top left.

 

I still cant see why BCOBS to date has failed if you based your letter on the RBS or the satans bank one.

 

there have been a couple of BCOB court successes now.

I will dump them anyway, but also want my £500 back. Im not scared to take CC action, i just dont know the process or the costs involved

so NW are aware [obv] that the majority of the income into the account was from benefits but still took chagres out?
