      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I wonder if anyone can help and what my rights are.

I took my car for new tyres and tracking doing at kwik fit (Zafira 2.0 DTI). When they inspected the vehicle, they came into the waiting area and told me that the track rod ends needed doing x4 (front inner and outer?), stabilizer links x2, and 2 arms (not quite sure) also needed doing.

 

I asked for a price and they quoted me £508. I said if it needs doing then it should be replaced. TBH, I didn't know what any of these were (apart from tyres and tracking). I spoke to a friend and he said ask for the parts that supposedly needed doing and let me have a look at them.

When I showed him the parts that had been replaced, he said only 1 stabilizer link needed doing as their is nothing wrong with anything else that had been replaced.

He advised me to get a professional opinion from Vauxhall just to confrim that they should not have been replaced the good parts.

Vauxhall confirmed my worst fears and said that these parts should not have been replaced as they look only 12 months old.

So they have charged me for work of over £300, that didn't need doing.

What can I do about this please?

I'll be ringing Kwik Fit head office in the morning and also letting them know that I will be contacting trading standards.

Any advice would be helpful

Get it on paper from Vauxhall, it will make life a lot easier should KF decide to be funny. It really is about time this outfit was taken to task in law.

 

Maybe a line to BBC Watchdog, if they have other complaints there, they will investigate.

Hi, my Registration number is (Edit) It's a Vauxhall Zafira 2.0 DTI. It was supposedly repaired (replaced good parts for new parts for no reason) at your Birstall store.

I am going back to Vauxhall to get it written on paper that these parts in their opinion shouldn't have been replaced.

Kwik Fit have taken £263.50 from me for work that didn't need to be carried out.

What is it that you'll be able to do about it by having my reg number?

My daughter has a very similar problem with being mislead by Kwikfit, went in for front pads and they told her all pads and disc needed replacing. Paid £640.

 

 

Had the disks checked and the rear ones were less than half worn, no scoring or other damage.

 

I also had problems with Kwikfit over a tyre with a small tack in the centre of the tread, they told me I needed TWO new tyres (both had only done a few thousand miles) Drove to National tyres; they checked and repaired a simple puncture.

 

Kwikfit managers are on very good bonuses based on turnover, so guess what?

 

They will get customers through the door with a cheap estimate then add lots of unnecessary work.

 

DO NOT complain to Kwikfit – they will just refund your money and fleece the next customer through the door.

I have reported them to BBC Watchdog - why not do the same, it's very easy.

 

They must take many thousands of pounds from unsuspecting customers every week – they need to be stopped.

 

Just got a quote from the BMW main dealer which included resetting the warning message AND replacing the sensor £515.52 which is £125 LESS than Quikfit for more work and parts!!
