Tragic and unnecessary death, it is high time the Government took this situation seriously, on top of this others are being harassed by companies such a MMF making outlandish threats.

I would urge everyone who has trouble of the sort to complain to the OFT and the FCA and make their MP aware and encourage the MP to ask questions in the House.

AGGRESSIVE DEBT COLLECTORS OR WAY OUT OF MONEY PROBLEMS?

 

The death of Antony Breeze comes at a time of intense criticism of the payday loans industry.

Last week two payday lenders were ordered to surrender their trading licences after a crackdown by the Office of Fair Trading.

 

The OFT said that it is also currently investigating three more payday loans firms for bad business practices and they too could be shut down. The OFT could not name them for legal reasons.

 

The Payday Loan Company Limited – which operates under anumber of names including Cashnet and Paydayloans.co.uk - and Anfield Cheque Cashing Centre have both given up their consumer credit licences and will no longer be able to trade.

Last month the consumer body sent letters to 50 leading payday lenders asking them to take immediate action to overhaul their businesses.

 

The OFT accused firms of failing to conduct adequate assessments to see if applicants can afford loans, failing to explain how payments will be collected, aggressive debt collection techniques and not treating borrowers with sensitivity and patience.

The Citizens Advice Bureau has also accused lenders of pushing people into debt by failing to check that borrowers can afford to repay loan.

 

In a survey of 1,270 payday loan borrowers, with loans from 87 payday lenders, 65 per cent of people did not get asked about their financial situation when taking it out, according to research by the CAB.

I saw on the tv last night, a new company called "Amigo Loans" were advertising. Persuading borrowers to "find a friend to guarantee" their borrowing ?

 

Up to £5,000 can be had as long as you have someone who is prepared to take the risk that the loan will be repaid ?

 

I would urge people not to fall for this one.

Yes, I think so, Brig. I think this is why so many people end up in trouble with more than one PDL (supposedly). They sign up for one company and find another helping themselves to the bank accounts.

 

TBH, I really don't understand how they can be allowed to do this.

There's a reason why this government wont do much regarding payday lenders and it has to do with one of their donators.

Thats a very sad story. I'm sure there are many other such stories that go unreported. I have only dealt with CashGenie of that three mentioned and they are pure ****.

They come a close 3rd behind Toothfairy and minicredit on the list to avoid.

Amigo loans have been around for quite some time. Indeed cash genie are a nightmare with calls from them and carter forbes. Same switchboard though as i found out once when i called one number to be answered by the other company.

That was a turning point in how i dealt with them. Call it my lightbulb moment.

 

Frankly i can understand how debt leads to suicide.

If you dealt with the amount of tragedies, and desperation borne out of debt that I have seen over the years especially relating to those who being in debt is both demeaning and embarrassing you would see why it drives the to suicide!!

This is a tragedy. Having personally dealt with Keyes Whitlock on behalf of their parasite PDL Payday UK, they will stop at nothing in harassing customers. I received 18 calls in one day, 9 mobile 9 at work threatening bailiffs, doorsteppers, CCJs and a visit at work. It was only FOS intervention did they back down.

The FCA is in action and has teeth, and what it does will be open to public scrutiny unlike the OFT which cannot respond to complainants.

I hadn't realised they had changed over. As for the OFT I know they can moth respond but they should log all complaints.

 

This was my understanding as well, fletch. That any complaint made to the OFT then forms part of a record. Then when there are a number of complaints, the OFT are supposed to swing into action.

 

What I would like to know is at what point the number of complaints fulfil the criteria required for the OFT to jump before they are pushed, into action.

 

I can remember when I first joined CAG, there was a very long running Link thread. Anyone who had found themselves involved with that company where asked to send a complaint to the OFT. Judging by the number of people who said they had complained, I am very surprised that Link still have their licence.

 

There have been some extremely high profile cases.. for instance .. Harrison v Link. Which identified both them and their usual partner in crime as not candidates for creditor and DCA of the decade, let alone year. Yet they are both still very much in existence with apparently no censures against them.
