Hi legal gurus,

 

My girlfreind recently got laid off alongside some others at work. Frustratingly she knew they'd never be reemployed, however long story short this meant she got no job seekers allowance for some time and basically caused her a lot of grief - they didnt give a damn. :mad2: They were basically trying to liquidise the company, get out of paying their contractors, cut staff where lehgally possible and start over again as a new name with no debts in their name. She was owed over two weeks pay, which the company said she 'may' get back when the liquidation questionaire came through. Well, shes had a letter this week saying that she will not be getting anything. What is her next course of action? This company is now trading under a new name, with the same staff and directors, writing off any previous debts and commitments by doing this, all their previoust contractors who do work for them also wont get paid.

 

Im making sure the contractors all know their new name so they can avoid them like the plague!

When was she dismissed?

 

If it was less than three months ago she could still go down the ET route naming the first and second company as respondents, bringing claims for outstanding wages etc and a failure to inform and consult over a TUPE transfer (if a transfer occurred).

well surprise surprise, she came to the end of her 'lay off period' and was then told that the company is in liquidation. Annnoyinlgy all the old staff and directors are still at the building! Just a brand new name and expecting to trash and move on without paying anyone!

To get proper advice you need to find out more technical legal details about the type of insolvency process that has been used. Try going on Companies House Direct to see what has actually happened with the company. If an Insolvency Practitioner has been appointed you should contact him/her.
