Hello

 

A PDL company issued a claim against me on MCOL in early March. I acknowledged service, and admitted part of the claim,and put in a defence for the rest (the biggest part), within the time limit, and put in financial details to ask for time to pay. (I am on a DMP which the PDL wouldn't accept)

 

I've tried to log back in today to see if anything is happening, but there is no longer a link to the claim, and if I put the Claim Number and password in the boxes, it just comes up with the message "claim number or password is incorrect"

 

Is this normal at this stage of the process? Should I still be able to view my details?

 

Are the PDL company expected to respond to my defence, or does it go straight for judgement?

 

How do I find out the result? Does it come in the post? And normally what timescale?

They've possibly discontinued because you submitted a defence.

 

A lot of PDL company's do this! They were probably hoping that you didn't acknowledge or defend so they could get a judgement by default!

 

Advisable though to speak to somebody at mcol to confirm this.

Oh silly me, I have 2 government gateway accounts, and was logging in under the wrong one, so although I was putting in the claim details correctly in the search box, it wasn't there. Logged in under the other account and I found it.

 

No response from the PDL company yet, so will keep monitoring. How does the countdown work now?

Hello

 

I have a payday loan of under £300 through Safeloans which I have been paying off for over 2 years now.

 

 

They issued a court claim,

 

 

I put in a defence,

 

 

it was ajourned with liberty to resume and

 

 

I have been repaying a fixad amount.

 

 

I am now nearing having repaid twice the amount borrowed.

 

 

They still want more than another £200 from me.

 

 

I would like to offer a token full and final settlement amount to end this.

 

My question is,

if they took it back to court,

legally can they still ask for the amount they want

or would they be limited by the 2 x loan amount given for newer loans?

Why was it adjourned ? Did the claimant request this ?

Why would you offer a f&f? They've had more than they are entitled to. It sounds like they've kept adding interest and charges and you're blindly accepting it.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
