      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I emailed that guy. I received an out of office reply. But on it was the names of 2 others to contact if we needed help. I sent them both a copy of my complaint lol. The more the merrier. At least it shows I am making every effort to set up a repayment plan.

yeah id do the same. keep all ur emails...everything, even the ones.... its not likely but if it ever went to court you would have proof that you are trying to sort a repayment but they are not allowing you to do so. so providing you keep on their ass, the judge should be on ur side.

 

keep at it, cos theyre known to sell it on to a debt collector if the person doesnt pay, or if the epayment amount isnt high enough...usually Mackenzie Hall, who are TERRIBLE to deal with.

 

Anytime u need statements of ur account, email pete too...as hes provided last couple of my statements.

Not personally but the posts ive read on the site are shocking, and thankfully my repayment was high enough for them to keep it with them xx cant wait til next march when its all paid...no more payday loans after omg

Result. Thank you turkwyfe for your advice about emailing that guy. One of the ones that I copied into has just called me. He is taking the £162 off what they said I owe. He has agreed the repayment plan that I asked for. He is going to email me all the details. He said any problems then email him direct.

I wrote a complaint about the fact that £162 was added and that they would not supply me with bank details. I said that I was going to complain to every financial governing body. I will be paying into their bank account. He is going to write it up and send me a copy via email

Direct Debits are a very very bad idea with PDL's. Standing order only. If they refuse, then use postal orders.

I know they are renegade but ive had it for last 8 months without a prob, until today but they took direct debt out this afternoon rather than this morning...plus im using a prepaid card to pay it bk so once loan is paid, and i have confirmation, i will block the card xx

DD's are normally authorized days in advance. Somethings not quite right here.

Its ok. Ive been in touch with that guy who address I gave you a few times and always got a response with a day or so, and i know QQ are a pain in the ars e to deal with so im glad you got this sorted within a few hours rather than it continue any longer!!

Ive sent SAR request to QuickQuid which they received on June 3rd, and someone signed for it

 

I have just a couple of questions if anyone knows.

 

Is it possible to check whether the Postal Order has been cashed, and

What happens if they fail to respond to my SAR request with the 40 calendar day period which will be 12th July 2013.

TO check if the postal order is cashed, take the receipt and/or unique number to any post office and ask them to check. You can also do it online, but it's not updated often.

You send them a SAR non-compliance letter.

If you have the receipt, it will have a unique number or barcode on it. Just pop along to the Post office and ask them to check if it has been cashed. To check online, just use royal mails track and trace application.

Think you have to wait at least 14 days before you can find out.............

 

Phone the Royal Mail at 00-44-8457-223-344. Give the identification number on your receipt and ask the Royal Mail to trace the postal order and find out if it has reached its correct destination and been cashed.
