Tower Capital have raided my bank account of my job seekers allowance, this is for £55 i have severe diabetes and am hypoglycemic and need a stable diet they have my weeks money i have not authorized them to take this money as i have been disputing charges on the account. my bank are Halifax and they are refusing to do anything to assist with this.

this money is surely covered by social security act 1988

The Bank must refund you any unauthorized transaction immediately as long as you don't act fraudulently (burden of proof would be on them) and as long as you notify them that the transaction is unauthorized without undue delay (and within 13 month max).

 

Get a written complaint to the Bank demanding their final answer on the matter, if they still don't budge, take it up with the FOS.

 

Where a transaction is found to be unauthorised, the PSP has an obligation to immediately refund the amount of the transaction and, where applicable, restore the account to the state it would have been in had the transaction not happened.

The Bank is wrong, you gave the card details to the payday loan company for the purpose of one specific transaction, to charge the amount due under the signed crddit agreement on the original due date, any other transaction you never provided consent for.

 

By the Banks logic you could pay for some groceries at tedco by card and tesco could charge your card for the stuff bought by someone else on a different day, which very obviously would not be legal.

i have severe hypoglycemic diabetes and if i don't have this money back to get food i will have to admit myself to hospital

The Bank is wrong, unfortunately it can take some time now to get it sorted cause the Bank is breaking the Law and the Justice system is slow.

 

Can you borrow some food from neighbours or family to last until tomorrow?

 

Would have to see then if some help would be available for example from the social fund to tide you over until the Bank makes right on its obligations.

 

While it should theoretically not be necessary as the Bank should just follow the Law and refund the payment immediately, in your situation it may be a good idea to head down to the Benefits office first thing in the morning and apply for a Community Care Grant, just claim you need help filling in the form when you go there, that way you can apply immediately instead of being sent home with a empty form and having to return.

Based on you being on in receipt of benefits plus suffering from a serious medical condition and being the victim of a crime and the funds being for basic necessities I believe you should have good chances to get a Community Care Grant approved.

Have had the money back this morning through the disputes team in my bank, fraud wouldn't take it on as I has a relationship with the company and disputes couldn't do anything till it has cleared. Have ordered new card and emailed tower capital inviting them to commence court proceedings! Many thanks for all the comments guys
