Confused.

 

Have the bank refunded you, so you are at no loss ?

 

Have they cancelled the debit card related to these dodgy entries ?

 

If the answer to both questions is yes, then just keep an eye on your account, to make sure no debits are made that you have not authorised.

We could do with some help from you.

The bank have cancelled my card and told me no payments relating to the old card will be allowed through so hopefully for future use i am ok.

 

In relation to these charges the bank have not yet refunded these, they have raised a pending fraudulent dispute

so that when they are actually shown on my account in a few days they can then refund them.

 

They did however say if their fraud team believes i have had dealings with this company on any basis they will not refund them.

 

I said i defnitely do not know who Lasker International are.

 

They said i should be fine.

 

My concern is now that Lasker International are passing the buck to capital credit management whom i provided my debit card details to take the token payment last week.

 

So if they tell my bank thats who took my money my bank will probably debit it again from me.

 

Sorry for being so long winded.

Wait to see what happens. No reason for the bank not to refund you. If they don't refund, then make a complaint about the bank allowing unathorised and fraudulent payments through.

What Lasker/debt collection agency has done to you is a typical con trick.

 

They get you to pay a £1 which then starts the whole debt timescale of 6 years again and they also have your bank account details.

They never had any intention of just taking £10 a week or month.

They will drain your account and leave you with no money for food or the means to get to work etc.

 

The first thing I would do is change my bank account, even if it meant a basic account and have my money paid directly into that.

This way you will be in control.

Even a Cashplus can be done within days with all the usual banking facilities and without some of the charges.

Once you have another account set up then demand the bank refunds your money.

 

This debt collection agency has no lawful authority to make you pay anything.

They are a third party and there is no contract between you and them.

 

Ask them to prove this debt, proof of agency and supply you with a copy of the original credit agreement signed by you.

They won't have it.

 

If they bought the debt from a payday loan company then the debt is settled.

 

You should thank them really for paying off your debts but there is nothing in law that says you have to pay them.

 

This has been a painful lesson for you, but I'm sure you won't make this mistake again.

I am setting up a standing order now and have cancelled the direct debit.

 

The debt is for £210 or something to that effect.

 

The bank has advised that they cannot take anything further from my account as the only way they can take from my account with only my account details is through direct debit.

 

They cannot lift any money out of my account any other way without the card number

and the bank has said any payments to that old card number will now be immediately declined so they should have no other way of accessing my money i hope

Both me thinks.

I'm dealing with the OFT at the moment but it's a long process.

 

8 weeks for them to reply to you with a final response and then upto 12 weeks if you need to take the case to an adjudicator.

 

Don't know about trading standards but both have the power to cause the DCA serious trouble, and the OFT can award compensation as well.

I cannot believe this thread it is word for word exactly what happened to me on the 2nd October ..

 

... I was also told to f*** off when I managed to speak to a man who claimed to have nothing to do with Lasker collections

but was Lasker Investigations although that company dissolved in 2010

 

- my bank is also looking into it but it was only today I found the connection to CCM whom were adamant they hadn't passed on my card details

and had never heard of Lasker Collections

 

- Richard Howlett previously of Lasker now Director at CCM.

 

I am hoping the bank sorts this out they tried to take money on 6 occasions and only managed 50.00 but went in total for 640.00.

 

I have sent them an email telling them they are under investigations and reported Lasker to the CSA and Trading standards and also that I have cancelled my direct debit !!!!

Im in shock to be honest that something identical has happened to you.

 

Im actually still so angry that i was told to f**k off on the phone!.

 

I presume from reading your post that CCM were adamant they hadnt passed your details on.

 

They told me the same although to be fair they seem a dodgy enough company,

they only answer the phone when it suits them and seem very unprofessional in their dealings.

 

Obviously the link in it all being this Richard Howlett who judging by other things i have read about him he is a nasty piece of work.

 

I think i read somewhere previously that they have been warned for their conduct previously.

 

I have cancelled my direct debit also and have downloaded a form for complaint through OFT.

 

I will be sending a letter into them on monday with my complaint form.

 

I also will be sending a strongly worded letter to both Lasker and CCM. I will invite them now to issue proceedings and take me to court.

 

I think they would be destroyed through the court when they agreed to my direct debit payment of £10 per month

and got a token payment yet then proceeded to use my card details through another company to try and clean me out.

 

I sincerely hope now that someone looks into their conduct and that they dont get away with this.

 

I certainly dont intend on letting it drop.

I meant to ask if you dont mind telling me what bank you are with.

 

I just wanted to know if they took any different approach than my bank.

 

Im with santander.

 

Im fearful that even though they say i will be refunded within 48 hours that they will then rule in favour of this company.

 

How do i prove i have never dealt with them.

We have been telling people to put a letter into their bank instructing them not to make any payments under any circumstances to these companie

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Please learn from this that in future NEVER deal with a DCA over the phone, request that everything is put in writing and hang up. GOLDEN RULE

 

NEVER give your bank or card details. If you must pay, do this through a Standing Order or internet banking payment - insist that the company give you their bank details.

 

I think that this DCA has abused their position, whatever they say, and I would be reluctant to pay them anything - IMO. Have they sent you any documentation proving that they have any right to collect this debt?

 

Who was the original payday loan with?

 

Keep on at Sandander and quote the FSA guidelines to them. Send them an official complaint if necessary

Something smelly going on here. Must be reported to Action Fraud. This is not a case of a mistake. Someone somewhere is putting through varying amounts, which seem to coincide with people contacting CCM.

I am also with Santander and I have the same fears as you,

firstly they tried to tell me they will look into it after 15 days

then they said it would be back in my account in 48 hours which hasnt happened yet.

 

I am awaiting their decision before i make my next move because i am not standing for this as previous post stated

i will involve police if need be as this is clear criminal activity and yes ccm claim no knowledge.

 

I have sent an email to james patterson who i received 3 threatening emails off previously even though it says they do not see incoming mail

but i will also put a hard copy in the post

 

I have all my evidence so if they want to take me to court i will welcome such action as long as they are prepared for a counter claim along with criminal charges

I made a mistake earlier when I said I was dealing with the OFT but can't edit it for some reason.

It's actually the FOS.

I'd call them to open a complaint, they will then take details and contact the DCA.

A copy of the complaint will arrive in the post and you can sign the form and email it back.

 

OFT can also be emailed but will only log the complaint, not act on your behalf.

It is worth copying any complaint to OFT as they are looking into the whole pay day loan industry and need to be bombarded with as much evidence as possible. Also they will be interested in the behaviour of the DCA in this case. True that they cannot deal with individual cases that is FOS or Trading Standards

Hopefully when santander sees this happening with a couple of accounts they will look into it properly.

 

Surely they will see two customers cant be telling lies on the same day about the same company.

 

I think the way they have left it with me is that i will be refunded then they will look into it and if they decide i was at fault they will take the money back.

 

If they do do this i will be firing off complaints left right and centre as i am so determined now not to lose my money.

 

James Patterson also was the one who wrote emails to me.

 

They do say it doesnt take replies but it does.

 

I also have written by email to Richard Howlett telling him he has been reported.

 

Someone really needs to look into this as its terrible practice.

 

I have cancelled the direct debit and i hope they attempt to take me to court as i am well ready for it now.

 

They couldnt be content at getting £10 per month and i also assured them at that time that if i were to ever come in to any extra funds

i would of course pay off the balance in a lump sum but until that time i had to pay direct debit monthly.

 

I have copy of that email sent over a week ago when i initially set up the payments.

 

I am interested now to see what will happen.

What i want to know now though is how this lasker came to have my debit card details.

I know the link was richard howlett but it seems to say he worked for them a couple of years ago.

I think richard howlett is a director ccm is in the same area as Lasker

it just appears that they are the same people just with a name change

but he is using lasker collections to gain unauthorised funds

probably thinking its not traceable

 

- but im no miss marple and if i can find the connections im sure the authorities can.

 

The only thing im confused about is who the guy that so politely told me to do one is !!!!

 

He appears to be the only person answering that 020 number i called !!!!!

 

And he did tell me he was lasker investigations ( even though i discovered they no longer trade )

 

i have been tempted to call police but think i will wait on an outcome .

 

Its not even the money now its the principle x

Thats exactly what i want to know is, who exactly is he.

 

The bank had given me a number for them that they had as a reference it was 08703213999

it just rings once then says your call cannot be answered at this time.

 

I googled them and got the 020 number and it was on this number that i was told to f**k off.

 

I then called back furious and i said do u think its common manners or practice to tell someone to f**k off on the telephone.

 

He said dont swear at me.

 

I said i dont swear lightly and im disgusted at what was said to me and im merely repeating it to ask you why you chose to speak to me like that.

 

It was then he said there are only 2 of us here and we wouldnt have said that.

 

I said dont talk nonsense and he then said we have had 3 different people on today about this and we have nothing to do with it it is capital credit management

and the merchant for payment must have made a mistake its nothing to do with us and rubbish like that.

 

Have you complained to capital over the phone also?

No i have put all in writing because ccm deny taking any payments or knowledge of lasker

- u r braver than me cause i couldnt face phoning that man back because of how he spoke to me ..

 

. I called another number on the webside and spoke to someone who said he doesnt know lasker they were a drainage company ?????

 

Its all a mystery but clearly the guilty party is ccm and i just hope the fraud department get to the bottom of it ..

 

. Its great someone else has gone through this obv not from a financial point of view but clearly the more people it has happened to the stronger the case x

I agree with you totally and especially as it has happened us both at same time and with same bank and all the circumstances are identical

even down to how the man spoke to us on the phone.

 

CCM also denied all knowledge on the phone to me they acted completely innocent.

 

Im so so furious at the whole thing and i will now not be paying them a penny and actually hope they do decide to take me to court.

 

I think this richard howlett is bad bad news by the sounds of him.

Thats what my worry is also.

 

I will keep a check on my account through online banking every day to make sure they dont.

 

I was concerned though is there any other way they can take money from our accounts with our account number and sort code?

 

I know now that we have cancelled our cards that they they cant take that way but im still slightly concerned.

 

Do you use online banking?

 

Im only lucky that i do as a lot of people just rely on their statements.

 

Im so stringent with money lately (have no other choice) so i check my account daily sometimes twice.
