was wonder if you could help me write a email quoting some of the OFT rules, to NDR about the amont of people chasing this debt as yesterday email said marshal hoares legally now own the debt but yet this morning ive had 2 emails off NDR for 2 different amounts collecting money tonight. Im going to update my complaint to OFT yet again.

 

This is a reminder that you committed to pay back your Speed Credit Pay Day Loan* debt.

 

This debt is now very overdue. We have allowed you to extend the loan as a goodwill gesture.

 

As part of settling this debt you are committed to paying GBP 240 by 09.08.2012.

 

In accordance wih the Standard Terms and Conditions you agreed to, we will be automatically taking payment tomorrow as agreed. Please ensure the amount of GBP 240 is available by midnight tonight.

 

If there are insufficient funds in the account the payment might fail and all charges will IMMEDIATELY become due, ALL back dated interest, penalty fees will be charged.

Recovery Agents will be sent to all addresses we have on file for you in order to obtain payment. Should this also prove unsuccessful we will be liaising with solicitors who will obtain a County Court Judgement against you. Once this is secured we will return with a Warrant of Execution from the County Court and certified Court Bailiffs to seize goods at 9 times the value of what you owe.

Theres no real point quoting the rules to them. They know the rules but ignore them. Plenty of people have written to them quoting the guidance, but NDR and speedcredit simply send standard replies back.

 

That letter you got in your last post though really needs to go to the regulators and trading standards.

Do we all just sit back to wait and see what happens within the 28 days now? speed credit tried to take 2 amounts from my bank last night and i recieved an email from speed credit collections saying it had been declined so obviously my debt was still owned by speed credit.

Even though Speed Credit has been closed down, they will sell the debt to another company.

Well if they get sold on let's hope its to someone that actually follows the Oft rules and shows a bit understanding, can only hope for that suppose

No chance of that. All DCA's and debt buying companies act the same way. Mainly because they know theres a massive profit in it for them.

 

Remember, only a very very small percentage of debtors know their rights, the rest think the DCA's etc are acting legally and pay them whatever amount they owe. THis is why they now have standard form letters that threaten, bully and harass, as so many people fall for it, the industry has gotten used to it.

This makes for an interesting read that i recieved today, apparently if i pay now they'll knock £400 off the total

 

We apologise for the confusion and misunderstanding regarding the correspondence you have been receiving. We are the sole collectors, collecting on behalf of Speed Credit. ( nope there not ive been contacted by speed credit and NDR also today)

Any payments made less than £40 will be added to your file but WILL NOT be known as a payment plan nor will we freeze any interest.

According to our records you took out a 14 – 28 day SHORT TERM loan on 12.06.12 for £200.

You currently owe £820.

You agreed to repay your short term loan within 14 days. Payday loans can become expensive if you do not keep to the terms and conditions that you agreed to when you took out your loan.

Please note that as you borrowed £200, you are being charged £48 every 14 days. This is CLEARLY STATED in the terms and conditions YOU agreed to.

YOU agreed to the terms and conditions with your double digital signature by way of entering your email address in twice then clicking \'I accept and agree to the terms and conditions\'. The terms and conditions that you agreed to are legally binding under The Consumer Credit Act 1974.

Ok ill not make any, does them knocking that money off not show that they know they cant really justify the £350 charge and late fees they keep adding?

Tinkerbell.

Have you still got the original email that they sent when you applied for the loan.This email should have contained the terms and conditions of the loan.In the T/C's,there is a section regarding charges or the amount you should pay for transmission fee.My transmission fee should have been £4.90,but they tried it on with for £5.00.Which is a blatant disregard of the Trades Description act.

 

9. CHARGES

 

9.1 The following charges are payable under this Agreement:

9.1.1 transmission fee (GBP4.90);

 

I know that they have updated their T/C's,which also includes something about that they can alter the T/C's at their will.

Also if you read the email i recieved yesterday that said marshall hoares are the soul collector for my debt, then why did speed credit try to raid that account last night which the bank obviously declined. Also it states i have upto the 20/8/12 to make any arrangments of repayment plans with them before they make additional charges, then why did i recieve this email this morning.

-further letters and telephone calls to contact you at your home and place of work ( i believe they arent allowed to contact you at work and they can if they want because i dont work anymore)

-our agent will make visits to your premises for the purpose of obtaining payment

-we will gather all evidence and prepare your file for presentation to your local County Court ( i wish they would hurry up and follow this threat through)

 

Should you be unable to pay in full within 7 days, an instalment plan may be accepted depending on your circumstances. (ive already offered them £10 amonth at the max which is more than theyd get in court)

 

If you wish to pay by instalments you should contact one of our customer service operators as soon as possible on 08433811111. ( ive already told them to only contact me in writing)

 

 

 

Wish these 28 days would hurry up and pass im sick of these idiots filling my junk mail up everyday

Keep all that communication. If you do go to court you can show all the threats and the fact they are ignoring you. Plus the fact that a completely different company who you havent dealt with is trying to collect as well, even though the company lost its license and isnt meant to be linked to tf in any way.

im currenly in he same situation tinkerbell renegade is helping me with a complain also.

 

hopefully ndr and marshall hoarse will go down with them too. ive been stupid enough to repay 50pounds already tho. now i owe 411 marshall have sared applying exre charges

also i was going to contact marshall hoares today regarding the charge on trying to access the site however its down. as is the ndr website. its either going down with speedcredit or they are cutting all ties with speedcredit and going to somehow sell the debt to themselves.

 

 

when you was getting emailsd though were they coming from fraud@marshallhoarse.co.uk or .com. fraud seems a really unusual starting point its normally info or somehing

seems everyones banging their head against the wall with this company, i cant see how NDR and Marshall hoares wouldnt get closed down with them since theyre all part of the harrassment this company applies.

I wrote another very lengthy complaint for the attention of the compliance manger of speed credit last week, usually with the other complaints ive sent i just recieve an automated email response the same day from them that never answers any of the points ive stated to them, but theyve choosen to ignore me completely, i know you have to give them 28 days to reply to complaints but other ones ive sent they never really acknowledged them anyways, and in 28 days theyll be closed anyways.

They take the stance that if they ignore it, then it hasnt happened, or that they can say they never recieved it. It's why we state over and over, that recorded delivery letter, or email cc'd to yourself, and pref one other email address is the best method to get around their antics.

Ive been CC myself in emails with them they just choose to ignore me, the exact same as when ive pointed out to them that theyve signed for my recorded delivery letters from royal mail, they just point blank ignore that too. They must only have 2 more weeks left to appeal? I cant see how they would even have the nerve to appeal after what they got caught doing, and they treatment theyve put people through

was just wondering if you could read through my newest complaint ive made with speed credit that doesnt seem to be sparking a response to see if theres something i could of put in a better way.

Also NDR are trying to claim money tonight even though Marshall hoares said their soul collectors funny that innit.

 

Dear sir/madame

 

I recieved the following email off marshall hoares on the 16/8/12 stating that they are the soul collectors of the debt but on the same day speed credit tried to take amounts from my account even though ive cancelled continous payment authority with you, i sent it recorded delivery and it was signed for. Any attempts to take any money from the account will be classed as theft as you DO NOT have premisson to take any amounts.

Also i have asked numberous times for a FULL break down of the £350 charge on the account and you refuse to give me a full explanion of what its for, i will not being paying for this chrage because YOU refuse to jusify it.

Aslo this emails states i have until the 20/8/12 to reply but yet on the 17/8/12 you sent an email saying your already commencing proceedings because you have no heard from me. I have emailed you numberous times, its not my fault YOU choose to ignore me , feel free to commence with your proceedings so i can show a court how much effort ive put in with dealing with the debt and how much you as a company have been ignorant and not even tried to accept my current situation and tried to acommadate it. Ive offered you a repayment plan and you've rejected it, i will also show the court that too.

Also the OFT rules state that only 1 company should be dealing with the debt at a time yet, speed credit, NDR, applenton massey and mrashall hoares have all contacted me at the same time, this is harrassment. Please inform me who actually owns the debt, my account is in dispute and wish for you to deal with my complaint in the correct manner that the OFT rules state.

FIle it with the OFT and trading standards and treat it as if you never received it. They are trying to play ignorant, and hope you give in to their demands.
