So...after all last week's excitement this week has proved to be a huge let down. Nothing from HSBC and nothing at all from DG...and im now over my OD limit :(

 

it's starting to do my head in now. Anby advice on any ways i could speed them up a bit? which i imagine is doubtful...

25th spetember - Sent off S.A.R - (Subject Access Request)

11th October - Calculated all charges

Drafted prelim letter

Did spreadsheets

16th October - Sent prelim letter to Ian Shepherd

17th October - Letter delivered. 14 days starts today!

Will you be charged fro going over your OD limit? Might be worth sending them a quick letter asking for those to be waived too?!

I will almost certainly be charged mate. I will ask them to waive it but they may do what they did last week where they waived it then when i turned down their offer they took it out again :(

 

No way? They can't take it out again, surely?

 

How about sending them a letter with an updated balance?

 

I know you want this over with ASAP but maybe try calling them instead??

Yeah i think i'll do that. I got my acknowledgement of service from DG on the 24th saying they intend to defend and it was dated the 21st November. I got another offer a week later and i havent heard anything since.

just beware... if you start asking for more charges back you are heading towards account closure!

Not a problem if you are not worried about that (I wasn't)

You could just let this one run its course, then open another account

somewhere else then claim against HSBC seperately for these ones?!

 

Just make sure you don't agree to it being full and final settlement for charges claims!

The 28 days for them to file a defence? To be honest, they will probably enter a defence the day before, or on the day....but if they don't you need hit the judgment button on MCOL striaght away the day after the deadline date.

 

Then follow the steps to get a judge to issue a CCJ against them!

what do you get in the post when they file a defence? is it that letter from DG where on the second page they have the details of DG and who is dealing with it and the box is ticked saying they intedn to defend?

 

If so that was sent to me 3 days after i filed my MCOL.

That sounds like the acknowledgement of service - if it is headed with paper with the court's details on it.

 

When they enter a defence, you'll get a piece of paper with loads of pioints on it, you'll also be sent an Allocation Questionnaire to be filled in from the court.

Im worried, my MCOL 28 days are up tomorrow what do i do exactly? Do i just click on the judgement button thing on my MCOL? Then what happens? im worried about this AQ business and the extra 100 squid as i thought that was only for claims of 5 grand and over? (mine is £1303)

David, the £100 is for claims of over £1500 so you won't have to pay it.

 

The likelyhood is they will enter a defence at some point, recent activity has shown that even if you apply for judgement first, the court will still accept a defence.

 

As far as the AQ goes, it is simply another step in the process. It is very simple to complete. There is a time limit of 14 days for it to be filed but as you have no fee to pay you may as well get it in as soon as possible. Other cases, (except mine, for some reason), have shown this is pretty much the home straight.

Court papers issued:- 13/11/2006

Citifinancial/DLC:- Ongoing since 21st August. Now part of an OFT investigation into Debt Collection Practices.
