Fault on a settee just over 1 year old, does credit card cover it?

Bought a 2xsettees which where delivered Dec 2010.

 

In Feb 2011 one of them failed and needed repairing.

 

During 2011 the colour in the leather came out of the end of the arms, ie the very end where you have the trim finish, the wife said she'd used a cleaner but only after it had come out, they said the cleaner contained alcohol the company that makes it said they where talking crap and didn't know anything about their product.

 

Dec 2011 reported that the settee that had been repaired had failed. They said they'd someone out, no one came till Feb 2012 obviously the settee had got worse.

 

Company is refusing to repair it.

 

Bought on a credit card. Is there anything I can do?

 

Also they claim it's been "mistreated" and stated under consumer act I have to prove it wasn't. However looking at where it's failed there is one screw holding the side of the suite into a piece of plywood about 1cm (max). If the corner had been reinforced with a piece of 4x2 and one other screw I doubt it would have broke.

 

As for mistreatment well the screw has basically fell out of the hole, it's not ripped it's way out downwards.

 

Any comeback?

 

Looking at where it's failed I can probably fix it, using a piece of 4x2 for the screws to go into, wood glue and a few screws.

If DEBT is the problem REPAYMENT is the solution

Both the CC company and the retailer can indeed insist that you prove that it was an inherent fault via an independent report

Ex-Retail Manager who is happy to offer helpful advise in many consumer problems based on my retail experience. Any advise I do offer is my opinion and how I understand the law.

Yes, after 6 months you'll need to get an independent report. Initially this is at your own cost, but if the report states that it's a manufacturing fault then the retailer is obliged to repair the item and reimburse the cost of the report.
