Hi all

 

I am doing this thread to help my wife - she had never heard of this wonderful site until meeting me :-)

 

Basically back in July 2009 my wife stopped using her account, BUT a card payment was authorised by Nationwide to NEXT (the card was used by mistake) pushing the account over by £8.19 (the limit was £350)

 

The account has had charged against it interest and unauthorised overdraft charges since then and now stands at: £541.30 that is charges of approx £182???

 

We never got any letters about this, and as far as I am aware received no statements until they started chasing for the money.

 

They have now contacted us saying the following:

 

1: They will accept a one off payment of £363 (to be paid in 7 days)

or

2: Will accept a payment plan - for the full £541.30 if we fill in a Statement of means (we have no money and I mean NO money)

 

What should our next move be??? I cant see how its fair they will accept a payment plan, but will not remove the charges

typically with the balance being mostly charges

and the fact they are offering a discount

they'll go nowhere near court

 

you might find BCOBS useful in this instance

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
