if you had an account which was closed 10 years ago but which inccured loads of charges, why can you not claim these back? If it is only now that you have found out that these charges were infact unlawful, there was nothing that could have been done at the time as you didnt know but now you do why not?

I can see no reason why these charges shouldn't be reclaimed, regardless of when they were incurred. The Limitation Act creates a 6 year statutory bar to claims but provides exemptions if the original debt was accrued due to fraud or mistake.

Claim the charges and let the banks show that the claim is statue barred. Unless they think they have a very high chance of success then it is going to be commercially very unleasant to be seen to be publicly arguing with a customer about their honesty and integrity.

Hey Karen

I hope those 3 husbands are grateful and that the others don't start to feel neglected ;)

Go for those charges. As Phantom says they will have to prove they weren't defrauding or being negligent and that means taking the stand and they ain't gonna do it just yet!
