Yes I am also chasing up egg, my case is currently with Trading Standards. However as I have had no luck with them I will soon be moving it to court.

an update on my case today i have had my first letter from egg, well its not actualy egg but their new solicitor Eversheds of Cardiff, a Notice of Change Name of Solicitor. lets await to see if they settle up soon and not waste the courts time anymore.

no caro, as you know i went into the court 2 days after the egg dead line and was told they had put a defence in but it has not been sent to me as of yet, but having a new solicitor now wouldn't they want to now be allowed to put a new defence in.

I think they would need permission to do that CB. I'm surprised you haven't received a copy from either egg or the court. I'd be inclined to chase it up with the court again.

The changing of solicitors is, I assume, due to Citi buying Egg Cards? Shudder.......... this could mean....Eversheds & Citi in the same sentence!

What Happened to Addleshaw & Goddard???

 

I was informed by Egg that they had changed solicitors, the change was to Addleshaw & Goddard of London EC1, Manchester & Leeds...well that was the firm that represented Egg at court on Monday 29 January 2007, I actually conversed with the Addleshaw & Goddard's legal young man who was acting as defendant for their Client Egg. ( I factually asked him to remove the sardonic smurk from his face!)

 

Surely, Egg have not changed their Law firm again...and now it is is Eversheds!

 

Good Grief, something must be up!

Firstly, we have to suffer the incompetance plus intimidation from Mr. Nelson St. Clare, then Addleshaw Goddard and now Eversheds, who are possibly in the top three.

 

Please note, countrybake that the judge ordered both me (Claimant) and Egg (defendant0 14 days to send in the Court Bundle...I provided my Court Bundle within the requested timescale 14 days. However, Egg failed to provide their requested Court Bundle.

 

Egg only started to scurry, when I made my Application Notice for a Draft Order for Directions....All of a sudden the got their bottom in gear, providing the requested docs. on the Order, because if they had not, then a consumer friendly judge could have Struck Out their Defence, due to their non compliance in not providing the required docs.

 

Please be aware that this is simply just my humble opinion.

In Lincoln, a district judge put on the orders the following

 

IT IS ORDERED THAT

 

The Court of its own motion is considering striking the Defence out as an abuse of process on the basis that it has settled all previous claims of this nature. If the Defendant objects to this course of action it is to file at Court within 14 days, a Schedule setting out a list of all claims it has pursued to trial and all claims it has settled.

 

 

This was one of 4 cases where the judge made a stand against banks wilfully dragging out some cases to cause distress to claimants whilst having settled with full payment in other similar cases. Any claimants about to appear in court, might like to draw the judge's attention to same.

 

Legal eagles on site can no doubt provide the places and dates of these 4 judges' orders, but I would think any judge can obtain same with ease, and no judge likes to be manipulated.

 

Memo to Egg: however rich you are,

the majesty of the law stands above you.

have you had the new defence yet Countybake ? Any updates.... ?

 

no i have not got it yet but today i have had a letter from off eversheds saying they will pay a quarter of it and no default mention plus a tomlin order with stupid conditions on it, they will get a response back saying no in simplified way.

at the momment though i am very busy doing a court bundle for my rbos claim due to be sent on wednesday could some kind person please tell me what i need to send as a statement of evidence please i am not sure weather it is the witness statement any help would be much appreciated.

cheers for that karne i have now sent the court bundle off for the rbs 250 pages * 3 what a nightmare glad thats done anyway.

update on the Egg claim i have sent eversheds a reply to their dingy offer saying no to offer and a definate NO to any conditions they put on it being settled out of court and that i won't except any payment until i recieve a letter off egg saying they will remove default.

no corespondance from my letter rejecting settlement and for a copy of the defence that they had to submit, just a waiting game at the momment not even a court date as yet.

It's worth calling the Court and telling them you haven't had a copy of the Defence yet and that you are therefore unable to form a response.

chears for that i will do that tomorow, i have also just recieved a judgement for claimant in default, this is for my local barclays bank what do you do with it get the ballifs in and if so how or just wait a week to see if they send a cheque or have it set aside.

yes it was not concluded and then out the blue a debt collection agency wanted wat was owed i ignored and then i had a N1 so i replied to that saying you need to sort this one out first and now judge has put a hold on it and that is it for now
