      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Glad you all replied to Zippy. Of course it's relevant an unlicensed drug for this age group has been dispensed without due care. It's unlicensed for that age group and there are rules attached to that. It will be of great significance and relevance in this terrible situation.

 

That's very good news Tilly. The personal communication has started. I'm sure safeguarding and the CQC will be raised. You can see how this meeting progresses first, and then decide whether you need to contact your Trust.

Great news, best of luck for Wednesday. Know that you will take notes but had you thought of an independent person being present i.e. not family? Past experience has taught me that no matter how nice people are (or appear to be) always nice to have that independent person around for clarification at a later date.

Meeting with GPC lasted just over an hour...where a 4 page witness statement was taken from daughter in law,and copies of wrong meds box, signed a letter for dpa to give permission to speak to grandsons doctor and access to his medical notesVery reluctant to answer any questions asked .:roll: she

was only there to collect all the evidence and will going on to the surgery from here.All the evidence and witness statements now get passed to the fitness to practice dept at the GPC with her report where they evaluate the complaint.So the ball is rolling.

Good progress Tilly. The GP Practise is involved now so all the professions brought together. Glad the proper procedures are now in motion. Must be a great relief the investigation is being taken forward for you now after all your efforts to get moving. Well done.

Well it gets better..few more things have come to light reading through my daughter in-laws notes

it turns out that on the said day...there was only 2 staff on should be 3.... 1counter staff.. 1dispensing assistant and the duty pharmacist.On this particular day there was no counter staff so the dispensing

assistant was put on the counter leaving the pharmacist to check her work which is normally double

checked.Also the wrong meds where stored along side the right meds.

 

The complaint forms are filled in and ready to go Monday morning

 

Has it been clarified if the assistant dispensed the medicine and the pharmacist checked it?

Pleased the meeting went well and glad you had a work colleague with you. We shall now all sit and wait with you and your family for the next step. Not been on the thread as nothing to update until now....

 

At last things seem to be moving, i gave them a ring this afternoon and was told that the investigation

had been completed and all statements and evidence had been collected from all parties and has now been passed to the examination board to be assessed for a decision to be made,and we will recieve a letter in the next week or so.

Looking forward to seeing their report and findings:roll:

I hope you get a good explanation how it all happened and not just them saying " lesson will have been learned" As they usually say this but they never do learn do they it just goes on and on im just so pleased your baby grandson didnt suffer any after affects xx

Not forgotton about this thread.... still no further on since i last updated it has now yet again been passed onto another dept,despite phone calls from my daughter in-law and getting fobbed off with you will be getting a phone call shortly or a letter...sounds to me they are being given the

Re your post, this is just so typical of them isn't it? They listen, and you think they understand but then the shutters are closed. I suppose it's to do with insurance. But when oh when will they learn that we really need transparency, it is only in this way that mistakes will not be made in the future.

 

I just don't get how when it is so evident that a mistake was made, that it is not addressed, sorted and we can all move on andthey can learn from their mistake. It is always the case that they do not admit the mistake, cause goodness only knows how much in costs via insurance, hope that we will "go away" because we will give up. Why oh why don't they understand?

Well after months of waiting finally some positive news,the pharamist is being called to a hearing with the fitness to practice committee, the documents have been served and now awaiting a datewith the GPC in London which are also public hearings.

The fitness to practise committee hears cases where a registrants fitness to practise is in question and takes decisions. They can issue sanctions or take away their registration to practice number.So things are starting to move :-) and like Tags says hopefully can start to move on.
