      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've heard through the grapevine that next month it will be easier to claim, but that you will be limited as to how much you can claim back. is this true?

Is there a time cutoff that I must have claimed before?

I only joined yesterday and still have lots of reading to do before sending off my first letter.

Not that I'm aware!

Carry on reading as much as you can then start a new thread of your own with any questions you might have etc... This is a self help forum but there is guidance from lots of different sources you just have to be prepared to put in the work. Good luck, get started and then follow the process, you can't go wrong with this tried and trusted method.

Sent First Letter Asking For My Bank Charges To Be Returned, Had A Letter Back Today, Refusing And Saying They Dont Agree That They Are Ripping People Off With Bank Charges, And Said I Could Write To The Ombudsman For Help, So I Have Just Sent My Lba Letter To Them. Will Keep You Posted.

Hi, this is my first posting so pls bear with me!! Has anyone been refused their charges back from the Halifax? I sent the template letter requesting a refund and they have replied saying that I received a leaflet (!) which explained the charges, when I opened the account! In other words..no chance!! HELP pls

Hiya I'm new to this but I have been trying to claim my charges back since Feb 06, I finally got a letter stating that when I opened an account I agreed to their terms and conditions which explained these charges would be applied if i did not keep to the terms of the account. blah blah blah if you remain unhappy you can refer your concerns to the Financial Ombundsman Service.

Should I give up, or should I start court proceedings my claim is £5,702.00 plus interest which is £1,009.42

please help tearing my hair out now

Hi my claim with the Halifax, they paid the full amount into my account today £5635.05.

N1 filed 23rd May 2007

Deemed served 25th may 2007

Acknowledged 1st June 2007

Keep on fighting and you will get it.

Today 20th June I discovered that 2700.00 had been taken out of my bank, I rang Halifax and was told it was interest on a loan, I told them that I didn’t have any loans so she put me on hold and cam back after 5 mins and said theres been an error I will get someone to call you back in 5 mins (I smoked 5 cigs in 15 mins) got no call back so I rang them and they said sorry about the error your account as been refunded with the 2700.00 what a cheek?
