Hi All,

Need some advice.

Wasn't able to pay mortgage last month on time although have paid now and paid this months today.

Asked woolwich for mortgage statement and have noticed a £40.00 late payment fee on the statement which was applied on the 16th May.

Q, Am i able to re-claim this charge.

I am going to SAR the woolwich as a couple of years ago we were behind and had to cash my endowment policy in to pay the arrears otherwise we would of lost the house si i guess there is more charges which i hope i will be able toclaim back..

What was the claim with HFC about - if it was credit card or loan a/c penalty charges, then that would not really fit.

 

Have you read through the Stickies at the top of this forum.

 

I'll see if I can get some help finding a suitable reclaim letter.

Hi Peeps,

Ok response from woolwich today saying..bowlarks.

Already had lodged complaint with FOS.

Completed FOS forms with all relevant info ,now posted off to FOS for them to deal with it.

£500 fine for Barclays for FOS investigation..ha ha.

Hi TM,

 

I'd write to (I assume) Barclays referring to the Ombudsman's Decision and the fact that Barclays should have paid by XXdate.

 

Ask them to settle by return and send the FOS a copy of the letter.

 

I'd send the Barclays letter by Rec'd Del'y.

As for forcing compliance I think there are a couple of options.

Hi Twoman,

 

Martin has been discussing (with the Site Team) what options are available to you, in the event that Barclays fail to pay on time.

 

So we can consider this fully, can you confirm by what date the FOS expected the bank to pay you.

 

From post #17 above, it looks like Barclays have 4 weeks from or around 28th August. In which case, they may still pay on time (but don't hold your breath !!).

Hi All,

I referrred this back to FOS.

Just had a call from FOS saying that they reckon they have already credited back to account,..... [edit] liars and had sent confirmation,...no they ain't.

So just waiting for a response from either Sharkleys or FOS.

Hi Guys,

Update.

Ok got £400 credited back to account,happy with that......but since the original claim went into the FOS Barclays started to apply monthly arrears charges of £40.00 per month.

Now while i admit i'm in arrears (£500 ish) they have never ever applied arrears charges consecutively like they are doing now.It's as if because i complained it's there way of getting back at me.

I have referred this to this FOS again and await their response.
