Another quick question about the Data Protection Act.

 

Can I request the DVLA stop sharing my data under the Data Protection Act?

 

I know I cant stop them sharing data in a lawful way ( for example the POLICE ) but can I stop them from sharing them with Private Companies like Private Car Park Enforcement.

 

So I accidently park for 2 minutes more than allowed in the CO-OP car park, and the company responsible for the enforcement send off to dvla my reg and receive my data back.

 

Can I stop this????

They have a specific permission under the law to release information to anybody with reasonable cause to have it.

You need to goto the ticket section, most people say ignore them as it costs them money to take you to court.

From the Information Commissioners Website (under the DVLA section specifically) "it is an offence under section 55 of the Data Protection Act 1998 to unlawfully obtain information, for example by stating they want the information for one reasonable and lawful purpose when actually they want it for another illegitimate or unlawful purpose".

 

As we all know, the person who has breached the parking contract is the driver, the Private Parking Companies (PPCs) uses the legal gateway to obtain the Registered Keepers details (supposedly) in the first stage of their enquiries to trace the driver. At this stage everything is fine and dandy. BUT the PPCs, then misuse that data by sending out unlawful, threatening and intimidating demands to the RK and express no interest in identifying the driver whatsoever.

 

The DVLA are therefore complicit in this breach of the DPA because they know that this is what the PPCs do yet they continue to sell RKs details.

Myself and the DVLA are discussing this very point at the moment (I make a point of cc'ing Simon Tse into the emails to prove his knowledge and involvement in the much later (and inevitable) "Misfeasance in Public Office" allegation to South Wales Police)........I'm doing the discussing, they don't appear to be capable of answering a direct question with a direct answer though

 

Please feel free to email Mr Tse and point it out to him (again!).....the more noise the better

Hi Nev Met, what was the outcome of your discussion with the DVLA? I received a ticket yesterday for parking outside of the designated area (it was very poorly designated!) and am deciding whether to bother appealing or to just ignore it. Asking DVLA to refuse to sell them my data would be ideal, but I'm guessing if it was that easy, everyone would do it. Thanks

Believe it or not it's still 'work in progress' and I remain in discussions with the DVLA.

Thanks Nev Met - I can believe it, ridiculous as it is! It's ok, I'm going to write to them with photos and say I clearly wasn't causing any problems and that if they want me to pay they can take me to court. From what I've read, that seems to be pretty effective...

Possibly 'off topic'.

 

I see Simon Tse has other commercial interests, being a member of the Board of Directors and part of "The Management Team" developing "the business and brand".

Does this mean his job of making sure DVLA is the fine, upright, honest and helpful Public Service organisation that everyone expects from a Government Agency, is only a part time project of his?

 

Which could explain a lot!
