Hi Guys,

 

My mum was driving the other day and she was pulling out of a road and on to a main road.

 

The road was clear, she took the neccessary precautions to pull out, she went ahead with it. As she was pulling out, a car which WAS quite far instantly speeded up and crashed in to her.

 

The thing is, I've known the person to do things like this on purpous - to claim insurance money, but I can't prove that. It's the newest thing going in Birmingham and it's a shame.

 

The person who did it tried getting away, he had our details. But I took the means to stop him, which were cool with British law, so no problem there.

 

We asked him for his details and he wouldn't give them to us, but he has ours. (We didn't want to break the law). He claims his car IS damaged, but I have pictures that prove it isn't. (I'm guessing that he's gone and damaged it on purpous).

 

Furthemore to this, his number plate did not meet with British Driving Laws, there was too much spacing anad the letters were bolder than normal.

 

We reported this to the Police, they said it's an offence not to give details and they'll be prosecuting him aswell as the false number plate.

 

But of course if it's 'damage' then they cannot get involved. But my mum is innocent, there are also witnesses that saw what happened (more than four) what can we do?

 

It's quite stressful for my mum. Thank you for your replies. As for these illegal cases, can anything be done?

Hi Chucky,

 

All you can do is give your insurance company as much details as possible. You've got a lot of evidence and witness. Tell your mum to stop worrying.

The witnesses are worrying. They're just the local yobs who hang around the street corner. I have a doubt that they're simply being two faced and are invovled in this [problem].

 

However, CCTV is there I hope the local shops give it out. If anyone else can give any steps to take please do. How she should go about denying the accident etc.

Why don't you ask the local shops for copies now, don't wait for anyone else to obtain it or ask the police to obtain it.

Crash for cash claims are on the increase ([problem] accidents) so you are not alone.

 

Most insurers now have specialist fraudulent crash claim investigators, and so it is worth having a chat with your mothers insurance so that they can flag up the fact that this is believed to be a fraudulent crash claim and appoint the appropriate person to investigate.

 

The wrong spacing on a number plate has no bearing on a civil claim (which a crash is) although it is a traffic offence, and although many claims make an allegation of excess speed on the part of one of the parties, it is not usually a case of one or the other to prove they were not speeding, but for the other party to prove they were. However!!!!!! In this case, the fact that it appears that the third party appears to have made a deliberate attempt to accelerate does become significant, as does the lack of damage to the other vehicle. They will no doubt also make a claim for personal injury which is usually worth considerably more than a damage only crash, even thouugh they will probably be fake or phantom injuries.

 

Speak to your mothers insurers as a matter of urgency so they can get the ball rolling.
