sheriff officer's knowledge

Hi

 

I have just recently had an encounter with a Sheriff Officer at my front door. He asked me if i was the person on the Charge for payment sheet for Council Tax and i said no i wasn't then i turned around and went inside the house. This seemed to stun him. He then proceeded to slip the charge for payment form through the letter box. It says on the charge for payment that the it was served by "depositing it for you" and was signed by him the Sheriff Officer and by a witness who wasn't there. Does that make this document null and void?

 

 

I would also like to know how the Sheriff Officers trace where you work or how they get a hold of your bank account details?

 

The Charge for payment lists the Charge years and the warrant dates on the schedule on the reverse of the charge for payment sheet. Some of the charges date back to 1999. Could someone tell me if some of these charges/warrants are spent? The sheriffs are Scott & Co. Glasgow.

Once a Liability Order is granted the arrears remain until paid or the council decides not to persue them any longer. To have got to this stage in procedings the Liability Order has to have been granted.

A Charge For Payment is a formal demand for payment following a decree. A decree is a formal order of a court which says the debtor must pay money to a creditor.

 

In Scotland arrears of council tax and community charge can be recovered for up to 20 years.

and re work and bank account:

 

they will ask for your employers details which you are obligied to give and for bank details they will send you details name and address dob etc to every bank and ask if you have an account with them and again the banks must advise them

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.
