I have already, on 3 occasions, offered to take the pup back and refund her, but that's not what she's demanding, she wants full cost of pup, cost of his vaccinations AND the cost of the operation....and to keep the dog!

 

I would love to have the dog back, I would get the op done myself then find him a perfect pet home. He is of no use to her, as she keeps insisting 'he was purchased as a stud dog'......very strange, when she only picked him at 3 weeks of age and never visited again until she collected him at 8 weeks old, Wish I was that clever and could tell which ones would make perfect breeding dogs at that age, I have a written vets report here when they were checked over before leaving me and her own vet didn't pick up on anything either.

 

I do need to see her proof of claim though, so far it's just her word, which isn't good enough.

Agree wholeheartedly with this comment. I actually think you should start from a much harder position considering the paperwork you have and then be prepared to mediate towards taking the dog back in return for what she paid - nothing more. That way you are prepared to give a little ground and she is the one who will look unreasonable and grasping. She doesn't want to go to court and probably sees this as the soft option.

Don;t see why you can;t give them a quick bell and ask. If it is going ahead, don;t forget what I said earlier - this is a very emotive issue (for you - she is probably just an angry old harridan) so you need to take a deep breath and promise yourself that you will not, under any circumstances, retaliate to anything that is said. Let her speak, say her piece, but whatever is said, you stay calm and simply state your side. And the fact that you have the pup's welfare at heart here. I wonder if she even mentions "welfare"? Listen to her to see if she does.

 

Good luck, mediation can be very good, and is certainly nothing to be nervous about. But I understand you won;t know that til its over and done! Fingers crossed.

At long last it's finally over, she's agreed to me giving her a full refund on dog and me picking the dog up end of the week! Which is what I offered in November, but she was pushing her luck trying to get a full £1500 out of me! Seems the 'evidence' she claimed to have, doesn't exist, she doesn't have any vets report or photos as stated in her demanding letters to me. She knew she wouldn't win if it got to court!

 

Thankfully I have a friend that lives 1/2 hour from her and she is going to pick the dog up for me, she has a micro-chip reader so can scan the dog before taking him and I have asked for all documents signed back over to me! There is no way I could face this vile woman ever again.

 

At least my little boy is coming home and the well being of the dog was my main concern, she obviously had no feelings for the dog to return him so easily :x

Phew! Thank gawd for that. Well, she clearly doesn;t love the little one does she, because if she did she wouldn;t let him go. I hope you keep him because I imagine a stable permanent home is a must now to prevent any problems, you know, pillar to post stories! I reckon you WILL keep him and he'll be your favourite!

 

Well done, and now you know how it all works, if this ever happens again you'll be fine and confident.

My friend that is picking him up, is meeting us just around the corner from his now owners house, and we're taking him straight to the eye specialist to see what they say, the eye specialist said worst case scenario £300 but she reckons around £230.....so where this woman got £750 from is beyond me.

Good to hear you'll be getting him back and getting him healed up yourself............so I take it you didn't actually end up in court then ? She agreed to all this before or did you have to attend ?

I can't believe she'd part with him so easily-I'd never have let anyone have my dogs back once they were my puppies !!

I hope all goes smoothly for his handover and he's OK and she looks after him till you do and doesn't dick you about in the interim.

We had telephone mediation today, and as we came to an agreement it won't go to court, she told some lies to the mediator too, but once she agreed to letting me have him back, didn't want to rock the boat, so I've transferred the money to her bank today, and I have a friend collecting him from her on Friday, we had to sign the mediation agreement forms and send them back.

 

I had a feeling she didn't have any evidence, she's not sent me anything since starting her claim in November, even after her 3 letters stating what evidence she had to rely on with the courts, she actually didn't have any of it!!

 

I don't know how she let him go so easily either, seems the dog had a lucky escape, I'll make sure he's well cared for and pampered when he gets back poor thing, probably won't know if he's coming or going.

That's so sad it was all about the £££'s in the end. Times are hard but my dog would be the very last thing in my life I'd ever part with and I'm more than broke most of the time. Her cupboard is never bare, though, and her health is taken care of..........he'll be loads better off with somebody that gives a toss about him. I'd still be a tad worried myself, though, till I had him back for sure. I don't say that to spoil your joy at the agreement, but I just know how I'd be !!

Do let us know how it goes on Friday ! Good to know court wasn't required too.

I saw this thread too late. Was going to say dont worry about the small claims court. I took an ex boyfriend to small claims for 5k I had lent him by me taking an overdraft out for him years ago, yes I know, stupid! But it's not as daunting as you probably think, waiting in there is the worst bit. There is you, the claimant in your case & the 'judge' they dont have one of those wigs on. In a room with lots of empty chairs & a table. You both say your bit. If you explained all you had on here the judge would probably have sided with you. And in the unlikely event that they had found in the claimants favour, they would then need to Enforce payment, it's such a long drawn out process it's unbelievable! He didn't dispute it in the room but I ended up having to put a Charge on his property. He didn't like that as he wanted to sell the place sometime soon, so paid me back & I agreed to remove the charge!

Glad you got it sorted though. Poor pup as well as you x

He's ok, covered in fleas and ticks, doesn't know his name, not housetrained, very nervous, but with lots of TLC we'll get there, he seems to be improving even in the short time he's been here, this morning I was greeted with a very waggy tail from him in the kitchen :clap2:

That's sad to hear...so I guess it's lucky for him overall that he DID get sick or he'd have had a miserable life, it sounds to me.........you have to wonder what on earth is the matter with some people................it's good to hear you've already seen a difference in him. I'm so pleased he'll be taken care of properly now.

A good friend of ours picked him up from the owner, we were waiting just 10 minutes away, she scanned his micro-chip which they weren't too happy about, she told them she didn't know the dog so had to be sure she had the right one. They handed him over, no collar/lead, no mention of what food he's been on, no mention of when he was last wormed etc. and I'm still too angry to e-mail and ask, so he's now sporting a lovely new collar, KC documents now re-registered in my name along with his micro-chip, his tummy seems ok on the Royal Canin I feed my other dogs, just house training now and either a new name or getting him used to the one he had. The previous owner didn't even look back and neither did poor Henry :-(

That IS sad-especially handing him over with no collar even......it doesn't sound like they gave a toss about him and that does send me into a blind rage on his behalf....poor little fella'...he didn't deserve that. I don't understand it either-why pay over £700 for a puppy and not take proper care of him or give him love ???

What exactly is the Entropian you mentioned he has ? Is it an eye issue ?

Yes it's where the eyelid turns in slightly and rubs against the eye ball, it's his left eye, if you notice it's a little bit wet, but nothing major and something that can be sorted out, which we will get done, we'll also get him neutered so we don't have to worry about him being used at stud! It's also something neither parent has, they both have clear current eye test certificates and it would have been picked up when tested. So unless it's down the line somewhere we don't have a clue where it's come from. We've retired mum, she's now lying here fast asleep, I won't breed from her again just in case it's come from her side of the pedigree, but it's probably one of those things we'll never know. I've also told the stud dog owner, but that's up to her what she decides to do.

 

She obviously thought she would make her money out of him at stud and when the Ophthalmologist told them he shouldn't be used for stud and refused to even eye test him I guess all interest in him went out the window. He has endorsements on his pedigree papers so they couldn't use him at stud for registered litters, although I have been told 'unofficially' that he's already been used on a cockerpoo litter...........poor little boy, when he came into our house, we brought him into our dining room, let a couple of our dogs in to introduce them a couple at a time and he jumped straight on one of their backs as though this was expected of him. I told him he was a good boy and gently removed him and he's not attempted it since.

That breaks my heart to hear................the sooner he's fixed the better and he'll feel way less stressed into performing too.

I thought his left eye looked a bit off but didn't want to say anything and upset you as I wasn't sure if you'd perhaps used photo software on his eyes to correct a flashed eye as sometimes eyes look odd then too !! I hope it is an easy fix for him.

My little old girl I lost last March had to sadly lose an eye 6 months before she died. Three different vets couldn't figure what was wrong with her eye. By the time I was out of work and therefore went to see a PDSA vet they knew it was ulcerated beyond saving................but I was furious I'd paid three who'd done nothing to save it for her.

It doesn't seem to be bothering him thankfully, he's had the dye put in his eye at my vets and no signs of scarring so no ulcers, thankfully the irritation is minimal at the moment, other than a bit watery, he doesn't scratch it, or rub it in his bedding, but the sooner we get it fixed the better. This woman cared so little about him she's been fighting to see how much she could make out of me since start of November instead of getting him fixed!!
